"Pasal 53 ayat (2) UU Kekuasaan Kehakiman mewajibkan hakim untuk memberikan pertimbangan hukum yang didasarkan pada dasar dan alasan hukum yang tepat dan benar dalam putusannya. Hal ini juga berlaku dalam konteks Hukum Perdata Internasional (HPI), seperti perkara pewarisan internasional. Perkara pewarisan internasional adalah perkara pewarisan yang memiliki unsur asing. Lebih lanjut, terdapat pertanyaan dan/atau isu HPI dalam perkara pewarisan internasional yang mencakup hukum waris internasional, perkawinan campuran internasional, kewenangan mengadili hakim, dan isu hak orang asing atas harta warisan. Skripsi ini akan menganalisis tentang penyelesaian perkara pewarisan internasional dan sikap pengadilan Indonesia dalam menentukan hukum waris yang berlaku dari sepuluh perkara, yaitu Agnes Lee (2008), Agnes Lee (2015), Erlina, Reiger, Helga, Berg, Adolphe, Kirk, Whitechurch, dan Tan Mui Joon. Berdasarkan pengkajian dari sepuluh putusan tersebut, hakim masih belum dapat memberikan pertimbangan hukum yang tepat dan lengkap sesuai dengan ilmu HPI mengenai pertanyaan dan/atau isu yang muncul dalam setiap perkara. Selain itu, skripsi ini juga hendak menjelaskan tentang ruang lingkup HPI dalam pewarisan internasional. Terakhir, skripsi ini akan membahas tentang kehadiran RUU HPI sebagai solusi untuk memberikan kepastian hukum bagi hakim dalam menentukan hukum yang berlaku dalam pewarisan internasional. Penelitian ini dilakukan menggunakan metode doktrinal dengan bahan pustaka untuk mengkaji ketentuan hukum dan putusan pengadilan Indonesia.

Article 53 paragraph (2) of the Judicial Power Act requires judges to provide legal considerations based on the proper and correct legal basis and reasoning in their decisions. This also applies in the context of Private International Law (PIL), such as cases involving international succession. International succession cases are cases that involves foreign elements. Furthermore, there are questions and/or PIL issues in international succession cases, including international succession law, international mixed marriages, jurisdiction, and issues related to the rights of foreigners to inheritance. This thesis will analyze how Indonesian court adjudicating international succession cases and the stance of the Indonesian court in determining applicable succession laws from ten cases: Agnes Lee (2008), Agnes Lee (2015), Erlina, Reiger, Helga, Berg, Adolphe, Kirk, Whitechurch, and Tan Mui Joon. Based on the examination of these ten decisions, judges still struggle to provide legal considerations on questions and/or issues arising, with a proper legal basis and reasoning in accordance with PIL. Moreover, this thesis will also explain the scope of PIL in international succession. Finally, the thesis will discuss the presence of the PIL Bill as a solution to provide legal certainty for judges in determining the applicable laws in international succession cases. This research is conducted using a doctrinal method with literature as the basis for examining legal provisions and decisions of the Indonesian court."
