"ABSTRAK
Sebelum disahkan Undang-undang Desain Industri banyak ciptaan yang didaftarkan pada Direktorat Hak Cipta adalah ciptaan yang sebenarnya digolongkan sebagai desain industri. Keadaan tersebut dimanfaatkan oleh pihak ketiga dengan mendaftarkan ciptaan yang sudah terdaftar berdasarkan ketentuan desain industri kemudian ciptaan tersebut didaftarkan sebagai suatu desain produk berdasarkan ketentuan Desain Industri.
Tesis ini berisi analisis mengenai kemungkinan adanya pendaftaran atas suatu objek karya cipta berdasarkan ketentuan Hak Cipta dan Desain Industri serta upaya hukum apa yang dapat dilakukan oleh pencipta terhadap pihak ketiga yang telah mendaftarkan ciptaannya yang sudah terdaftar sebagai ciptaan berdasarkan ketentuan Hak Cipta, kemudian didaftarkan sebagai desain produk berdasarkan ketentuan Desain Industri. Penelitian dalam tesis ini bersifat deskriptif analistis dengan menggunakan metode penelitian kepustakaan.
Berdasarkan analisis tersebut diperoleh kesimpulan bahwa diperlukan adanya sosialisasi kepada masyarakat luas mengenai peraturan Hak Cipta dan Desain Industri yang berlaku serta persamaan persepsi terhadap kedua peraturan tersebut, sehingga diperoleh suatu pemahaman yang kongkrit serta upaya hukum yang dapat dilakukan oleh para pihak menurut ketentuan yang berlaku. Lebih daripada itu diperlukan pula para pelaksana hukum yang mengerti akan efektifitas pelaksanaan suatu undang-undang sehingga tidak menimbulkan terlalu banyak birokrasi dan distorsi atas peraturan yang ada.

ABSTRACT
Prior to the promulgation of Industrial Design Laws, Directorate General of Intellectual Property (Dirjen HaKi) often accepted the application for the registration of copy rights towards the creations which should be considered as industrial design. This situation had triggered third party to take advantage by registering a creation which previously had been registered under the laws of Copy Rights to be registered as a design product under Industrial Design's laws.
This thesis consists of the analysis with respect to (i) the possibility of a registration toward a creation pursuant to the regulation of Copy Rights and Industrial Design (ii) legal proceedings to be taken by a creator who already registered its creation under the regulation of Copy Rights towards third party who registered the same creation as design product under the regulation of Industrial Design. This Thesis is prepared based on a descriptive research and using the method of literature study.
This analysis concludes that a socialization on the regulations of Copy Rights and Industrial Design must be properly done therefore the same perception and clear understanding on the respective regulation including the legal proceedings to be taken by the parties, could be reached. Furthermore, it is also important that the law executors must fully understand about the effectiveness of law enforcement therefore the distortion of the laws could be avoided."

"ABSTRAK
Seni Batik Cirebon merupakan bagian dari Batik Nusantara yang perlu dilindungi
Hak Kekayaan Intelektualnya. Batik Cirebon cukup unik walaupun termasuk jenis
batik pesisiran tetapi memiliki batik Kraton karena memiliki dua keraton yaitu
keraton Kesepuhan dan Kanoman. Oleh karena itu permasalahan yang dibahas
adalah bagaimana perlindungan seni batik ditinjau dari UU Hak Cipta no. 19
Tahun 2002, Apakah perlindungan folklor sudah memadai dan efektif dan upayaupaya
apa yang dapat ditempuh Pemerintah Daerah Cirebon dan Pengrajin Batik
untuk melindungi seni batik Cirebon. Penelitian menggunakan metode normatif
yuridis dengan pendekatan kualitatif. Dari hasil penelitian diketahui bahwa
pengaturan mengenai Hak Cipta Seni Batik sudah ada sejak UU Hak Cipta 1987
sampai dengan 2002. Saat ini perlindungan Hak Cipta Seni Batik diatur pada
pasal 12 ayat (1) huruf i UU Hak Cipta No. 19 tahun 2002. Pada pasal tersebut
yang dilindungi adalah motif batik kreasi baru atau kontemporer yang
menunjukan keasliannya dan dibuat secara konvensioanal. Sedangkan untuk motif
batik tradisional yang merupakan folklor yang diwariskan dari generasi ke
generasi diatur pada pasal 10 ayat (2) dan Hak Ciptanya dipegang Oleh Negara.
Pengaturan mengenai folklor belum memadai dan efektif karena belum ada
kejelasan dalam penerapan pasal 10 ayat (2). Peraturan pelaksanaannya yang
berupa Peraturan Pemerintah sampai saat ini belum terbit. Upaya Pemerintah
daerah Cirebon untuk melindungi hak cipta batik Cirebon dengan melakukan
sosialisasi Hak Kekayaan Intelektual, dokumentasi motif-motif tradisional
Cirebon, publikasi mengenai seni batik cirebon dengan menerbitkan buku,
melakukan pembinaan kepada para seniman dan budayawan. Sedangkan
Pengrajin batik di Desa Trusmi sudah melakukan upaya untuk melindungi motif
batik tradisional yang merupakan folklore dengan melakukan dokumentasi motif
batik tradisional Cirebon sejak tahun 1950-an dengan mencari kembali motifmotif
batik tradisional Cirebon dan mereproduksinya. Namun kesadaran untuk
melindungi hak cipta motif batik kreas baru atau kontemporer melalui pendaftaran
hak cipta di Direktorat Jenderal HakKekayaan Intelektual masih kurang.

Abstract
Cirebon Batik is a part of Indonesian Batik which also needs the intellectual
property protection. Cirebon Batik is quite unique, since Cirebon has two kinds
of batik, coastal batik and court batik. Cirebon has two royal courts, Kasepuhan
and Kanoman. In this research will be discussed about the protection of batik art
according to Law of The Republic of Indonesia Number 19 Year 2002 Regarding
Copy Right (Copyright Law 2002), the effectiveness of folklore protection, the
efforts of Cirebon County Government and batik artisans to protect Cirebon Batik
Art. The research use normative legal research method with qualitative analysis
approach. Result of the research is the Provision of Batik Art?s Copyright has
been regulated since Copyright Law 1987. Today, Copyright protection of batik
art is regulated in article 12 verse (1) letter i in Copyright Law 2002. The article
protect of copyright of Original Batik motifs or contemporer which is made
traditionally. Whereas traditional Batik motifs as folklore or Traditional Cultural
Expression is protected by article 10 verse (2) and The State shall hold the
Copyright for folklores. Provisions regarding folklore is not effective yet due to
the lack of clarity on implementation article verse (2) and (3). Copyright that are
held by the State regulated by Government Regulation is not been published yet.
Bill of Protection and Utilization of Intellectual Property of Traditional
Knowledge and Traditional Cultural Expression (PPIP TKTCE) has been
introduced in September 2011. Cirebon County Government efforts to protect
copyright Cirebon Batik by socializing about IP Rights to Batik artisans,
documenting traditional Cirebon Batik motifs, publishing book of Cirebon batik
and giving education to traditional art practitioners. Batik artisans in Village
Trusmi (Cirebon batik production center) have documented traditional Cirebon
batik motifs as folklore since 1950s by several Batik Practitioners. They searched
traditional Cirebon Batik motifs and reproduced them. But, they have less
awarness to proctect their new batik motif creations by registering them to
Directory of Intellectual Property Office."

"There is an interesting link between the conception of copyright protection and the multimedia industry. The Copyright Law direction in identifying who authors are as well as defining the Copyright ownership ang the process of creation, including the legal status of elements used in the process. In its normal practice, the basis of determining the status of a creator and copy right ownership of multimedia works in commonly based on the scheme of creation made on the basis of orders. From the copyright perspectives, advertising and other multimedia works will only be protected if they are original, which stem from the author. To multimedia works, the Copyright Law present the occurence of modification, distortion, ang mutilation; while to adaptation works, thw law demands authors, intellectual honesty as a basis of recognition ang protection of their right. Unfortunately, the Copyright Law has not so far played its role as an engine of creativity for multimediacommunity. Instead, the law is often regarded as an abstacle in creativity and the exploration of creation. For that reaso, the law needs to be disseminated in order to play more intensive role as a driving force of creativity and a buffer to pillars of the creative multimedia industry in line with efforts to boots economic growth and public welfare. "
