"Maraknya perkembangan digital di era globalisasi memunculkan adanya keperluan untuk mengadakan penyesuaian pada hukum yang berlaku di masyarakat dalam relasinya dengan permasalahan yang dapat muncul dari perkembangan digital tersebut.  Perkembangan yang dapat dikatakan besar terjadi  dapat terlihat dalam hukum kebendaan, yang harus menghadapi berbagai benda yang muncul oleh karena perkembangan tersebut, seperti keberadaan bitcoins, file mp3, dan lain-lainnya. Dalam kebendaan tersebut, terdapat suatu benda yang dapat dikatakan unik, yakni akun. Keunikan tersebut muncul pada saat suatu akun tersebut ingin diwariskan, dimana muncul sebuah konflik kepentingan di antara ahli waris dan pihak penyelenggara jasa, di mana pihak ahli waris berkeinginan untuk mendapatkan haknya, sedangkan pihak penyedia jasa ingin menghormati perjanjian privasi yang sudah disetujui antara pihak penyedia jasa dengan pewaris. Dengan metode penelitian Yuridis Normatif, penelitian ini akan membahas tiga pertanyaan penelitian: Pertama,  mengenai status kebendaan dari akun tersebut secara sendiri. Kedua, mengenai mungkin atau tidaknya untuk akun tersebut diwariskan. Ketiga, mengenai mekanisme pewarisan pada akun yang disediakan oleh penyedia jasa daring yang terkait. Penelitian ini memperlihatkan bahwa dalam halnya pewarisan dari berbagai benda digital, terutama yang terkait dengan suatu akun, terdapat kurangnya kesadaran akan kebutuhan untuk menjalankan suatu tindakan agar suatu akun tersebut dapat diwariskan. Oleh karena itu, dalam rangka agar pewarisan akun digital dapat dilaksanakan, seyogyanya pemerintah mensosialisasikan agar masyarakat dapat menyadari pentingnya keberadaan persiapan untuk dapat dilaksanakan pewarisan dalam suatu akun.

The rise of digital growth in this era of globalization has shown the need for adjustments in existing law in society, in relation to problems that may arise from said digital growth. One growth that can be said to have happened rampantly can be seen in the law of property, which has to face a lot of new additions that came due to digital growth, for example in bitcoins, MP3 Files, among many other things. Within said property, there is an item that are of interests due to the uniqueness of it, which is an account. Such uniqueness comes from the conflict that arises when said property is about to be inherited, in which there is a conflict of interests between the need to be inherited by the inheritor and the need for privacy by the agreement done by the deceased and the service provider. By using Juridical-Normative method, this research shall be done to discuss three questions, which is on the property status of an account, on whether or not is it possible for the account to be inherited, and lastly on the mechanism provided by the service provider in regards to inheritance of aforementioned account. This research shows that in inheritance of digital property, especially on account, there is a lack of awareness on the need of preparation to setup an account to be inherited easily. For the reasons stated below, the governing bodies is expected to socialize about digital inheritance so that the people can understand and prepare their account better to be inherited. "

"As one of Asian countries, Indonesia has varied of cultures and religions. This variety affects positive laws in Indonesia, one of them is inheritance law. Indonesia has three inheritance legal systems, that is, adat inheritance law, Islamic inheritance law, and western inheritance law. Adat inheritance law is a norm of local adat community about inheritance. Islamic inheritance law is a norm of inheritance based on al Qur?an (Islamic holy book) and hadis (words, acts, and silence of Prophet Muhammad PBUH). In Indonesia, there are three schools of Islamic inheritance law, that is, Syafi?i?s (patrilineal) system of inheritance law (Imam Syafi?i is the most influenced school for Indonesian people), Hazairin?s (bilateral) system of inheritance law (Hazairin was Profesor at University of Indonesia had different view from Imam Syafi?i), and Compilation of Islamic Law system of inheritance law (Compilation of Islamic Law is Islamic law written by Indonesian ulama and Islamic experts). The last, western inheritance law is a norm of heritage based on Burgerlijk Wetboek as legal product of Dutch government when occupied Indonesia. All three inheritance legal systems are available for Indonesian people. We are able to know the availability of these systems is from legal cases in the courts, civil court and religious court. On the paper will be explained comparison of three systems of inheritance law, legal subject using the system (personality principle), and implementation of the system in the courts."
