"ABSTRAK
Tesis ini membahas perkembangan sistem klasifikasi Internasional yang menjadi
inti sistem perlindungan merek di seluruh dunia dengan menggunakan sistem
pendaftaran merek. Terbitnya edisi ke sepuluh sistem klasifikasi Nice pada Juni
2011 dan telah aktif secara resmi 1 Januari 2012 mencakup beberapa perubahan
signifikan bagi sistem klasifikasi internasional tersebut. Majelis Negara ? Negara
penandatangan bersepakat untuk mengalihkan beberapa barang pada kelas yang
baru dan membentuk kelas baru yang sebelumnya tidak terdapat dalam sistem
klasifikasi Internasional tersebut. Penelitian yang menggunakan metode yuridis
normatif yang mendeskripsikan secara historis perkembangan Perjanjian Nice
sejak edisi pertama 1957 hingga edisi ke 10 dan kemudian membandingkan
dengan PP No. 24 tahun 1993 yang dipergunakan Indonesia. Hasil penelitian
menunjukkan Indonesia sebagai salah satu Negara pengguna sistem klasifikasi
Nice namun bukan Negara anggota penandatangan Nice Agreement memilik
beberapa kekurangan dalam sistem klasifikasi yang tidak mengalami perubahan
sejak tahun 1993.

ABSTRACT
This thesis is discussing about the development of International Classification
System, which is the core system for the protection in mark in all over the world
by utilizing the system of mark registration. That the issue of the tenth edition of
the classification system of Nice in June 2011 which has been officially validated
on January 1st 2012 shall contain several significant amendments for the
international classification system. The countries signing the classification system
shall have agreed to transfer some products to the new classification and to form
a new classification, which has not been previously existed in the international
classification system yet. A research utilizing the normative juridical method,
which describing historically the development of the Nice Agreement from the
first edition in 1957 to the tenth edition, and thus compared it to the PP No. 24
year 1993 utilized in Indonesia was held. The result of the research shows that
Indonesia as one of the countries utilizing the Nice classification system,
meanwhile not signing the Nice Agreement, shall have some weaknesses in the
classification system which has not been amended since 1993."

Sengketa pelanggaran merek dalam dunia perdagangan tidak terlepas dari adanya
itikad buruk dari pelaku usaha untuk memenangkan persaingan yang kadangkala
dilakukan secara tidak jujur/ tidak fair. Salah satu tindakan tersebut adalah
tindakan passing off. Indonesia yang menganut sistem first to file (adanya
keharusan mendaftarkan merek untuk memperoleh perlindungan) sebagai sistem
perlindungan merek, pada dasarnya tidak mengenal konsep passing off, karena
passing off adalah bentuk perlindungan hukum bagi merek yang tidak terdaftar/
unregistered trademarks. Perkembangan teknologi menyebabkan merek juga
mengalami perkembangan dengan munculnya non-traditional trademark seperti
merek suara, hologram, tiga dimensi, aroma dan sebagainya yang walaupun belum
diatur dalam Undang-Undang Nomor 15 Tahun 2001 tentang Merek namun telah
diakomodasi dalam Singapore Treaty on The Law of Trademarks. Tesis ini
bertujuan menganalisis hal yang menarik dari Singapore Treaty apabila dikaitkan
dengan bentuk perlindungan hukum merek dan konsep pendaftaran merek di
Indonesia serta menganalisis perlu/ tidaknya Indonesia melakukan ratifikasi
terhadap Singapore Treaty untuk mengembangkan konsep perlindungan hukum
merek di Indonesia. Penelitian yang akan digunakan peneliti adalah bersifat
eksploratif dan deskriptif, dengan pendekatan kualitatif. Metode yang peneliti
gunakan adalah metode penelitian hukum normatif dengan pendekatan
konseptual. Hasil penelitian menunjukkan bahwa ratifikasi Singapore Treaty
relevan dilakukan Indonesia bagi perkembangan hukum merek nasional. Adapun
hasil ratifikasi sebaiknya dapat diakomodasi dalam Rancangan Undang-Undang
tentang Merek.

Trademark infringement dispute in world trade cannot be separated from bad faith
of entrepreneurs to win the competition which is sometimes done dishonestly/
unfair. One of such action is the act of passing off. Indonesia, which adopts a first
to file system (registration is a must to gain protection of trademarks) as a
trademark protection system, basically does not recognize the concept of passing
off, because passing off is a common law tort which can be used to enforce
unregistered trademark rights. Technological developments lead to the developing
of trademarks with the emergence of non-traditional trademarks such as sound
trademarks, holograms trademarks, three-dimensional trademarks, scent
trademarks, etc. Although haven?t been regulated by Law Number 15 Year 2001
concerning Marks, those trademarks have been accommodated in Singapore
Treaty on the Law of Trademarks. This thesis aims to analyze the interesting case
of the Singapore Treaty in associated with a form of legal protection of the
trademarks and the concept of a trademark registration in Indonesia as well as to
analyze the needs of Indonesia to ratify Singapore Treaty for development of the
concept regarding trademarks protection in Indonesia. This research characters are
exploratory and descriptive. Qualitative approach is used by researcher with
normative legal research methods and conceptual approach. The results shows that
the ratification of the Singapore Treaty is relevant to be implemented in order to
develop Indonesia trademarks law. The results of the ratification should be able to

"GSO segment above the Indonesia area was ever claimed by Indonesia's Government under its sovereignty, but in the subsequent development its sovereignty claim was changed to the preservation right claim in the use to put satellite in a certain place. Ratification of the 1967 space treaty made by Indonesia could influential to the position of Indonesia against the claimed to the GSO segment. The juridical and comparative method was used to examination the data above, the data was examined qualitatively. From the examination's data could be concluded that after the ratification's Indonesia cannot based on the reason again that Indonesia did not bound the 1967 Space Treaty against the Indonesian's claims in the GOS segment. Although Indonesia still have an interest for the sake of use in the GSO segment, but the Indonesia has to implement the Space Treaty 1967 in its activities."

"Hak atas merek menganut sistem konstitutif, sebagaimana yang ditentukan dalam Pasal 3 Undang-Undang Nomor 15 tahun 2001 tentang merek, dengan sistem konsitusif ini barang siapa yang mereknya terdaftar dalam Dalam Daftar Umum Kantor Merek maka dialah yang berhak atas merek tersebut dan dianggap sebagai pemakai pertama dari merek yang didaftarkan tersebut. Suatu pendaftaran merek harus ditolak oleh Direktorat Jenderal Hak Kekayaan Intelektual apabila bertentangan dengan Pasal 4(itikad tidak baik), Pasal 5 dan Pasal 6 (persamaan pada pokoknya dan atau keseluruhannya) Undang-undang Nomor 15 Tahun 2001 Tentang Merek. Namun pada prakteknya ternyata Direktorat Jenderal Hak Kekayaan Intelektual tidak melaksanankan tugasnya sebagaimana mestinya hal ini dapat terlihat dari kasus-kasus pelanggaran merek yang terjadi di Indonesia, beberapa diantaranya adalah perkara merek "SO KLIN" antara PT. Wings Surya melawan Yanti Tjandra, Putusan Pengadilan No. 13/Merek/2003/PN.Niaga.Jkt.Pst. Perkara berikutnya, putusan Pengadilan No. 48/Merek/2003/PN.Niaga. Jkt.Pst., diajukan oleh PT. Wings Surya dengan mereknya "WINGS" melawan Hony Suningrat dengan merek "WING". Kemudian perkara merek No. 57/Merek/2003/ PN.Niaga.Jkt.Pst. yaitu perkara merek "MUSTIKA RATU" antara PT. Mustika Ratu, TBK. melawan Arif Prayudi. Kepastian hukum yang diberikan oleh Undang-undang Nomor 15 Tahun 2001 Tentang Merek bagi PT. Wings Surya atas mereknya "SO KLIN" dan "WINGS", dan PT. Mustika Ratu Tbk. dengan mereknya "MUSTIKA RATU", yaitu dengan membatalkan dan mencoret merek "SO KLIN" milik Yanti Tjandra, merek "WING" milik Hony Suningrat dan merek "MUSTIKA RATU" Ratu milik Arif Prayudi dari Daftar Umum Direktorat Merek. Pembatalan ini dilakukan melalui proses persidangan di Pengadilan Niaga Jakarta Pusat."

"Istilah-istilah deskriptif digunakan dalam perdagangan untuk menyampaikan informasi kepada konsumen mengenai atribut, sifat atau keunggulan suatu produk. Merek yang hanya terdiri dari istilah deskriptif ini disebut sebagai merek deskriptif. Merek adalah suatu tanda yang digunakan untuk membedakan barang atau jasa dari suatu produsen dan produsen lain. Karena itu merek deskriptif seharusnya tidak dapat didaftar karena dianggap tidak mempunyai daya pembeda.. Merek deskriptif di Indonesia tidak dapat didaftar, baik di dalam ketentuan UU merek No. 21 tahun 1961 yang menggunakan sistem pendaftaran dekalaratif, maupun dalam UU Merek No. 19 tahun 1992 yang menggunakan sistem pendaftaran konstitutif, hingga UU Merek No. 15 tahun 2001 yang berlaku saat ini. Namun dalam kenyataannya di Indonesia terdapat merek-merek deskriptif yang didaftar, terutama berdasarkan Putusan Pengadilan.
Tesis ini meneliti mengenai masalah pendaftaran merek deskriptif di Indonesia, dengan menggunakan pendekatan konseptual yang meneliti mengenai konsep Secondary Meaning, pendekatan undang-undang dengan meneliti undang-undang merek di Indonesia dan pendekatan komparatif dengan melakukan perbandingan undang-undang merek di beberapa Negara berkaitan dengan masalah pendaftaran merek deskriptif. Pendekatan kasus juga dilakukan untuk meneliti putusanputusan pengadilan yang menjadi dasar didaftarkannya merek-merek deskriptif di Indonesia.
Dari hasil penelitian yang dilakukan didapat hasil bahwa masalah utama dalam pendaftaran merek deskriptif ini adalah tidak jelasnya pengaturan mengenai merek deskriptif ini dalam Undang-Undang Merek di Indonesia. Hal ini mengakibatkan terjadi perbedaan pendapat antara Hakim dan Pemeriksa merek mengenai merek deskriptif ini. Seharusnya dibuat suatu pengaturan yang jelas dan rinci mengenai pendaftaran merek deskriptif dengan memperhatikan keseimbangan antara kepentingan pemilik merek dengan kepentingan pihak ketiga sesuai dengan ketentuan dalam Paris Convention dan TRIPS Agreement.

Descriptive terms commonly used in the course of trade to convey information about attribute, characteristics or quality of a product, to consumers. Trademark, consists solely of descriptive terms is called Descriptive Marks. Trademark is a sign, used to distinguished goods or services from a producer from another. Therefore Descriptive Mark should not be registered because it lacks distinctive nature. Descriptive Mark in Indonesia is non-registrable, in the provision of The Trademark Act No. 21/1961 which used declarative system or in its predecessor, The Trademark Act No. 19/1992, even in the current Trademark Law in Indonesia, The Trademark Act No.15/2001. On the contrary, there are Descriptive Marks registered in Indonesia, based on Court and Supreme Court Decision in Indonesia.
This Tesis analyses the problem regarding the registration of Descriptive Marks in Indonesia, using Conceptual Approach which analyze the concept of Secondary Meaning, and using Statute Approach to analyze Trademark Law in Indonesia, and also using Comparative Approach to compare Trademark Law in various country in relation to Descriptive Mark. Case-Approach also used to analyze various Court and Supreme Court decisions in Indonesia that become Landmark Decision in Descriptive Mark registration problems.
Based on this Legal Research, we find that the major problem in the problematic registration of Descriptive Mark is because of the ambiguity of the current Trademark Law in Indonesia, regarding Descriptive Mark. This problem is causing different opinion between Judges and Trademark Examiner regarding Descriptive Mark. There should be more clear and comprehensive provisions in Indonesian Trademark Law about Descriptive Mark, which also considered the legitimate interests of trademark owners and third parties, based on the provisions in Paris Convention and TRIPS Agreement.
