As cultural criminology suggested, in this era of late modernity, media plays a huge part in an ongoing cultural construction regarding images and meaning of punishment which supported punitive attitudes. One of more prominent media that takes part in the construction process are the animated cerita rakyat which can be accessed through YouTube. These animation adopt traditional stories, or folklores, in Indonesia and are disseminated through video sharing websites and social medias. Using ethnographic content analysis method, this article attempts to uncover the meaning and images regarding punishment which are shown in the animation of cerita rakyat.
Result shows punishment are constructed as protection which are needed against the evil characters and as a way to give out retribution for their actions. Those images supported punishment as a favorable response to crime and further fostered by its depiction of nature of evil as personal choice and its emphasis on portraying the vulnerability of victims. All in all, these stories are part of cultural reference that society can draw forth for their punitive attitude toward crime and deviance."

"The use of intersectionality theory in the social sciences has proliferated in the past several years, putting forward the argument that the interconnected identities of individuals, and the way these identities are perceived and responded to by others, must be a necessary part of any analysis. Fundamentally, intersectionality claims that not only are people s lived experiences affected by their racial identity and by their gender identity, but that these identities, and others, continually operate together and affect each other. With "official" statistical data that indicate people of Color have higher offending and victimization rates than White people, and with the overrepresentation of men and people of Color in the criminal legal system, new theories are required that address these phenomena and that are devoid of stereotypical or debasing underpinnings. Intersectionality and criminology provides a comprehensive review of the need for, and use of, intersectionality in the study of crime, criminality, and the criminal legal system."

The objective of this research is to analyse the social construction and criminalization construction process experienced by Palabuhan Ratu’s traditional fishermen, who provide transportation services for migrant smuggling, which transit through Indonesia to Australia during 2010-2013. It is also to explain the dynamics of the interrelation between the dimensions and the fishing position in the constellation of interrelation among the various dimensions. They are essentially experiencing victimization of structural and cultural hegemony. In order to achieve the objectives, this research uses qualitative methods, which supported quantitative ones concurrently at the level of society. In general, the result of this research shows a shift of offenders to victims of crime, which symptoms of criminal behavior was constructed by internal and external situation of tradisional fishermen. There are three dimensions (state - supra state; transnational crime networking; and fishermen community) affecting fishing crime events, and the dynamic of every dimension is diverse. Intra and interdimension build up the constitutive interrelation, which in turn suggests that a crime occurred basically as a result of the reciprocal relationship between dimensions, the perpetrators and victims., which occurs not only globally, but also at the local level. When they conduct criminal act, they do it more to survive and as being part of a crime of accommodation. In the end, the difference in levels of the other dimensions sistematically victimizes the the traditional fishermen.
