"Tesis ini membahas mengenai pengaturan Rezim Hukum Negara Kepulauan Menurut Konvensi Hukum Laut 1982 dan implementasinya dalam peraturan perundang-undangan di Indonesia, tantangan dan hambatannya. Penelitian ini adalah penelitian kualitatif dengan menggunakan kajian normatif. Penelitian ini akan difokuskan pada pembahasan ketentuan-ketentuan yang menyangkut implementasi rezim negara kepulauan dalam peraturan perundang-undangan nasional Indonesia. Hasil penelitian ini menunjukkan bahwa Indonesia telah memiliki peraturan perundang-undangan yang sesuai secara keseluruhan dengan Konvensi Hukum Laut 1982. Meskipun demikian, beberapa ketentuan dalam peraturan perundang-undangan tersebut masih ada yang belum sesuai dengan ketentuan-ketentuan Konvensi Hukum Laut 1982, sehingga perlu direvisi. disamping itu perlu pengaturan hak hak dan kewajiban kapal perang, kapal pemerintah asing yang dioperasikan untuk tujuan komersial (niaga) dan tujuan bukan komersial ke dalam peraturan perundang-undangan Indonesia. Lebih lanjut Pembangunan bidang hukum rezim hukum negara kepulauan Indonesia hendaknya merupakan upaya untuk mengintegrasikan kebijakan-kebijakan di bidang pertahanan dan keamanan, pengelolaan dan pemanfaatan sumber daya alam laut, khususnya sumber daya ikan, penelitian ilmiah dan alih teknologi kelautan.

This thesis is reviewing Archipelagic States Regime of the 1982 United Nations Convention on the Law of the Sea and Its Implementation in Indonesia. This research uses a qualitative approach with normative methodology. The outcome of this research shows that he results of this study indicate that Indonesia has had legislation in accordance with the overall 1982 Law of the Sea Convention. However, some provisions in the legislation have not deal the provisions of Convention on Law of the Sea 1982, so it needs to be revised. besides that necessary arrangements rights and obligations of warships, foreign governments operated for commercial purposes (commercial) and non-commercial purposes in the legislation Indonesia. Further development of the legal regime of the Indonesian archipelagic state should be an effort to integrate policies on defense and security, management and utilization of marine resources, especially fish resources, scientific research and transfer of marine technology."
