"Tulisan ini membahas keabsahan Agresi Militer Belanda I dan II (Periode 1947-1949) ke Indonesia dilihat dari sudut pandang Hukum Internasional. Aksi Militer Belanda I dan II terhadap Indonesia selalu disamarkan dengan penggunaan istilah Aksi Polisionil oleh Belanda. Pengertian Aksi Polisionil dalam hokum internasional ternyata berbeda dari Aksi Militer yang dilakukan oleh Belanda terhadap Indonesia. Melihat fakta-fakta dilapangan, Aksi Militer Belanda ternyata lebih tepat dikategorikan sebagai sebuah Agresi Militer ketimbang sebagai Aksi Polisionil. Sebagai sebuah Agresi Militer maka Aksi Militer Belanda tunduk pada rezim Hukum Humaniter Internasional. Ternyata pada beberapa peristiwa, ketentuan yang tercantum dalam Hukum Humaniter Internasional ini dilanggar oleh Belanda. Pelanggaran tersebut dapat membawa dampak pada dinyatakannya beberapa perbuatan Belanda semasa melakukan Agresi Militer sebagai sebuah kejahatan perang.

This paper discusses the legacy of the Dutch Military Agression I and II (Period 1947 to 1949) to Indonesia from the point of view of International Law. The Dutch Military Aggression against Indonesia had always been camouflaged by using the terminology of Police Action. The definition of Police Action in international law is, in fact, different than that of the Military Action which was undertaken by the Dutch against Indonesia. Given the facts in the field, the Dutch Military Action could be categorized as Military Aggression rather than Police Action. As a Military Aggression, the Dutch Military Action must obey the International Humanitarian Regime. On contrary, in some cases, the Dutch broke the principles contained in International Humanitarian Law. This law disorder has resulted in the declaration that what the Dutch had undertaken during their Military Aggression was a war crime."

"Skripsi ini membahas tentang konsep konflik bersenjata non-internasional dalam beberapa konvensi internasional. Permasalahan hukum internasional yang akan dibahas adalah Pertama, mengenai konsep konflik bersenjata non-internasional dalam Common Article 3 Konvensi Jenewa tahun 1949. Kedua, mengenai konsep konflik bersenjata non-internasional dalam Protokol Tambahan II tahun 1977 dan Rome Statute of International Criminal Court tahun 1998. Ketiga, mengenai kategorisasi konflik bersenjata yang terjadi di Ituri, Kongo, terkait adanya keterlibatan dari negara-negara tetangga Kongo dalam konflik tersebut. Dalam mempelajari konsep konflik bersenjata non-internasional tidak cukup hanya dengan melihat pengaturannya dalam konvensi, namun juga harus melihat penerapan konsep tersebut dalam kasus yang ada.

The focus of this study is the concept of non-international armed conflict in several international conventions. The problems of international law that will be discussed are; First, the concept of non-international armed conflict in Common Article 3 of Geneva Convention 1949; Second, the concept of non-international armed conflict in Additional Protocol II of Geneva Convention 1977 and Rome Statute of International Criminal Court 1998; and Third, categorization of armed conflict in Ituri, Congo, related to the involvement of neighboring countries in that conflict. In studying the concept of non-international armed conflict is not enough just to look at the regulation in the convention, but also have to look at the application of these concepts in the cases."

"Pemberian bantuan kesehatan sipil dalam perkembangannya memegang peranan yang cukup penting di wilayah sengketa bersenjata yaitu untuk melaksanakan tugas-tugas kesehatan yang menjamin hak orang-orang yang terluka dan sakit karena itu terdapat perlindungan yang diterapkan oleh hukum humaniter internasional. Namun, meski sudah dilindungi oleh hukum, akhir-akhir ini para pihak pemberi bantuan kesehatan sipil seringkali masih diserang oleh para peserta konflik bersejata sehingga mengakibatkan kerugian materi, dan bahkan nyawa. Skripsi ini adalah penelitian yuridis-normatif yang akan membahas Hukum Humaniter Internasional yang melindungi pemberian bantuan kesehatan sipil secara melalui dua konsepsi, yaitu melalui perlindungan terhadap anggota dinas kesehatan sipil dan melalui perlindungan terhadap unit kesehatan sipil, yang terkandung dalam Konvensi Jenewa 1949 beserta protokol tambahannya serta hukum kebiasaan internasional. Melalui analisa kasus menggunakan sumber data dari kepustakaan dan wawancara, skripsi ini juga menyimpulkan masalah penerapan yang terjadi atas ketentuan-ketentuan yang melindungi pemberian bantuan kesehatan sipil di wilayah sengketa bersenjata. Hasil penelitian ini menunjukkan terdapat beberapa masalah penerapan yang terjadi karena beberapa ketentuan hukum humaniter internasional masih belum sempurna yang didukung dengan kurangnya kesadaran dan kepatuhan para peserta konflik. Karena itu, tatanan hukum yang ada perlu segera diperbaharui dengan cermat agar dapat menyelesaikann segala permasalahan penerapan yang ada. Segala macam publikasi dan gerakan sosial yang bertujuan untuk meningkatkan kesadaran dan kepatuhan para peserta konflik terhadap hukum humaniter internasional juga harus lebih banyak dilakukan.

Civilian medical assistance in recent times hold an important role in armed conflict to execute medical duties that ensure the rights of sick and wounded persons, therefore, it is protected by International Humanitarian Law. But nowadays, even if it is protected by the law, the stakeholders of civilian medical assistance are still often being attacked by the parties of the conflict which caused material loss, or even the loss of life. This thesis is a juridicial normative research which examine the International Humanitarian Law that protects civilian medical assistance in two different ways, by the protection of civilian medical personnel and by the protection of civilian medical units, contained in the Geneva Convention of 1949 and its additional protocols along with the customary international law. Through case analysis using sources from literature and interview, this research tries to conclude the current implementation problems that have occurred over provisions protecting the civilian medical assistance in armed conflict. The results of this study indicates that there are several implementation problems because some provisions of international humanitarian law are still imperfect, along with the lack of awareness and compliance practiced by the parties of the conflict. Hence, the existing legal system should be modified thoroughly in order to resolve the existing implementation problems. Any kind of publications and social movements aimed to enhance the awareness and compliance of the parties to the conflict shall be done more often. "

"This study focuses on the prohibition of sexual violence in armed conflict based on the provision of various international treaties and the sanctions that imposed on perpetrators of sexual violence according to the Rome Statute of International Criminal Court. The analysis on the provision of the Rome Statute of International Criminal Statute and its application in some cases of sexual violence in the Democratic Republic of the Congo. This study is based on the results of literature study with normative juridical method. Based on the result of this study, the provisions of the prohibition of sexual violence has not been properly applied in some cases that occur in armed conflict in the Democratic Republic of the Congo. Therefore, in addition to the provision of regulation, it is also necessary to establish the system of evidence that could facilitate the implementation of the sanctions to the perpetrators of sexual violence in armed conflicts.

Skripsi ini membahas mengenai larangan dilakukannya kekerasan seksual dalam konflik bersenjata berdasarkan perumusan dalam berbagai perjanjian internasional dan sanksi yang diberikan kepada pelaku kekerasan seksual berdasarkan statuta peradilan internasional. Analisa mengenai perumusan kekerasan seksual didasari pada ketentuan dalam Rome Statute of International Criminal Court dan penerapannya dalam kasus kekerasan seksual yang terjadi di Democratic Republic of the Congo. Penelitian ini disusun berdasarkan studi kepustakaan dengan metode yuridis normatif. Berdasarkan hasil penelitian, perumusan mengenai larangan kekerasan seksual belum dapat diterapkan secara baik dalam beberapa kasus yang terjadi pada konflik bersenjata di Democratic Republic of the Congo. Oleh karena itu, selain rumusan pengaturan, diperlukan pula sistem pembuktian yang dapat mempermudah dilakukannya penerapan saksi bagi pelaku kekerasan seksual dalam konflik bersenjata."
