"ABSTRAKPenulisan tesis ini bertujuan untuk mengkaji penetapan lisensi wajib dalam bidang ilmu pengetahuan dan sastra menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Permasalahan dalam tesis ini adalah bagaimana penetapan lisensi wajib dalam bidang ilmu pengetahuan dan sastra menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, sejauh mana Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta memberikan perlindungan hukum atas hak cipta yang diterjemahkan dan/atau digandakan, bagaimana konsekuensi tidak diterapkannya lisensi wajib dalam bidang ilmu pengetahuan dan sastra menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Penulisan tesis ini menggunakan metode penelitian hukum normatif dengan data sekunder sebagai sumber datanya. Penetapan lisensi wajib dalam bidang ilmu pengetahuan dan sastra menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta adalah terhadap ciptaan yang benar-benar dinilai penting dan diperlukan bagi kemajuan pendidikan, pengembangan ilmu pengetahuan, serta kegiatan penelitian dan pengembangan, oleh Menteri yang menyelenggarakan urusan pemerintahan di bidang hukum. Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta lebih memberikan perlindungan hukum terhadap hak moral maupun hak ekonomi atas ciptaan yang diterjemahkan dan/atau digandakan. Perlindungan ini juga dengan pengenaan sanksi pidana penjara dan sanksi pidana denda, namun tindak pidana yang merupakan delik aduan dapat menghambat penegakan hukum terkait pelanggaran hak cipta. Konsekuensi tidak diterapkannya lisensi wajib dalam bidang ilmu pengetahuan dan sastra adalah akan menghambat kemajuan pendidikan, pengembangan ilmu pengetahuan, serta kegiatan penelitian dan pengembangan, karena kurang tersedianya buku dalam bidang ilmu pengetahuan dan sastra dengan harga yang terjangkau dan dalam bahasa Indonesia. Hal ini akan menghambat minat baca, sehingga peningkatan kualitas sumber daya manusia Indonesia juga akan terhambat, yang akibatnya negara Indonesia akan terhambat dalam memajukan diri. Agar Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dapat dilaksanakan dengan baik, maka Pemerintah tepat waktu dalam menetapkan peraturan pemerintah, sehingga amanat Pasal 125 Undang-Undang Nomor 28 Tahun 2014 dapat dipenuhi. Bagi masyarakat, agar membiasakan gemar membaca buku ilmu pengetahuan dan sastra sebagai salah satu cara mendapat ilmu pengetahuan. Pelaku usaha penerbitan buku terjemahan agar lebih memperhatikan kualitas buku terjemahan sehingga masyarakat dapat menyerap ilmu pengetahuan dan sastra yang diterjemahkan dengan baik.

ABSTRACT

This thesis aims to assess the determination of compulsory license in the fields of science and literature according to Law No. 28 of 2014 on Copyright. The problem in this thesis are how the establishment of a compulsory license in the field of science and literature according to Law No. 28 of 2014 on Copyright, the extent to which Act No. 28 of 2014 on Copyrights provide legal protection of copyright translated and/or duplicated, how the consequences of failure to apply compulsory license in the fields of science and literature according to Law No. 28 of 2014 on Copyright. This thesis uses normative law research method with secondary data as its data source. Determination of compulsory license in the field of science and literature according to Law No. 28 of 2014 on Copyright is against the creation of a truly considered important and necessary for the advancement of education, the development of science, as well as research and development activities, by the Minister of conducting affairs administration in the field of law. Law No. 28 of 2014 on Copyrights is providing legal protection of the rights of moral and economic rights over the creation of translated and/or duplicated. This protection also to the imposition of penalties of imprisonment and fines to criminal sanctions, but the offense is a complaint-based offense could hinder law enforcement related to copyright infringement. Consequences of nonapplication of compulsory licensing in the fields of science and literature are going to hinder the advancement of education, the development of science, as well as research and development activities, due to lack of availability of books in the fields of science and literature at an affordable price and in Indonesian. This will hamper reading, thus improving the quality of Indonesian human resources will also be hampered, with the result that the state of Indonesia will be hampered in advancing themselves. So that Law No. 28 of 2014 regarding Copyright can be executed properly, the Government is timely in setting government regulations, so that the mandate of Article 125 of Law No. 28 of 2014 can be met. For the community, in order to familiarize likes to read science books and literature as a way to gain knowledge. Translation of book publishing business operators to be more attention to the quality of the translation of books so that people can absorb science and literature were translated properly."
