"ABSTRAKPerkembangan teknologi memberikan berbagai kemudahan dalam pemenuhan kebutuhan, namun juga menempatkan masyarakat dunia untuk menghadapi berbagai tantangan baru khususnya dalam menangani kejahatan lintas negara yang memanfaatkan teknologi pada sektor perbankan. Penelitian ini membahas mengenai pembukaan rahasia bank yang didasarkan atas permohonan bantuan hukum timbal balik dalam masalah pidana dari negara lain diatur dan diimplementasikan di Indonesia, serta implementasi terhadap pembukaan rahasia bank sebagai tanggapan atas permohonan bantuan hukum timbal balik dalam masalah pidana dari negara lain apabila tidak dilakukan penyidikan atas perkara tersebut di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, namun juga dilengkapi dengan informasi yang diperoleh melalui wawancara. Kesimpulan yang diperoleh dari penelitian ini adalah bahwa ketentuan mengenai pembukaan rahasia bank yang didasarkan atas permohonan bantuan hukum timbal balik dalam masalah pidana dari negara lain diatur dalam Pasal 40 dan Pasal 42 Undang-Undang Perbankan, Peraturan Bank Indonesia Nomor 2/19/PBI/2000, dan Undang-Undang Nomor 1 Tahun 2006. Adapun apabila tidak dilakukan penyidikan atas perkara yang berlangsung di yurisdiksi negara lain, tidak ada perbedaan ketentuan yang berlaku mengenai pelaksanaan pembukaan rahasia bank sebagai tanggapan atas permohonan bantuan untuk perkara tersebut. Saran yang Penulis berikan kepada Pemerintah dan instansi terkait adalah agar dapat dimasukkan ketentuan mengenai pembukaan rahasia bank untuk perkara-perkara pidana yang penyelesaiannya dilakukan di luar yurisdiksi Indonesia dalam Undang-Undang Perbankan dan penegasan kewenangan OJK untuk memberikan izin tertulis pembukaan rahasia bank berkaitan dengan permintaan bantuan hukum timbal balik dalam penanganan perkara pidana yang berada di yurisdiksi negara lain, serta maksimalisasi kerja sama informal agency to agency communication antara financial intelligence unit (FIU) seperti PPATK."
