"ABSTRAKPeraturan perundang-undangan adalah salah satu sarana untuk mewujudkan tujuan hukum yakni kepastian hukum. Undang-undang yang bersifat hanya mengatur secara umum, maka diperlukan peraturan delegasi untuk pelaksanaan dari undang-undang tersebut. Penyusunan peraturan delegasi undang-undang merupakan kewenangan legislasi pada lembaga eksekutif. Kewenangan legislasi diberikan kepada lembaga eksekutif guna mendukung lembaga tersebut mewujudkan negara kesejahteraan. Tesis ini membahas urgensi dari batas waktu penyusunan peraturan delegasi undang-undang. Motode penelitian yang digunakan adalah metode kualitatif, dimana penulis menganalisis sumber kepustakaan dengan fakta yang ada berdasarkan data yang dikumpulkan dan hasil wawancara. Tolak ukur pada tesis kali ini ialah pada peraturan delegasi undang-undang pada perlindungan anak. Anak adalah generasi penerus bangsa dimana negara wajib memberikan perlindungan. Pada proses penyusunan peraturan delegasi terkait dengan perlindungan anak banyak yang tertunda atau membutuhkan waktu yang lama. Penyusunan peraturan delegasi undang-undang yang tidak diatur dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan memberikan dampak yang tidak efektif pada penyusunan peraturan perundang-undangan. Oleh karena itu, mengingat Teori Efektifitas Hukum dan Teori Kepastian Hukum maka diperlukan batas waktu dalam penyusunan peraturan delegasi undang-undang.

ABSTRACT

Legislation is one means to achieve legal certainty. The implement the law which has the characteristic of regulating general terms, will need the formulation of delegation rules. The drafting of delegation rules will be conducted by the legislative authority in the executive branch. The legislative authority is granted by the state to its executive body to support its duty in order to attain the welfare state. This thesis discusses the urgency of the time limitation in the formulation of delegation rules. The research method used is qualitative method, by which, the writer analyze multiple sources of bibliographies along with updated facts collected from data and interviews. The benchmark used for this thesis is the delegation rules on the Law on Child Protection. It is implied by the law that children are regarded as the next generation of the nation where the state is obliged to provide protection. In the process of formulating the delegation rules related to Law on Child Protection, there has been many pending that often requires a significant number of time. The formulation of delegation rules is not regulated in Law Number 12 Year 2011 on the Establishment of Laws and Regulations has resulted ineffective impact on the drafting of legislation. In conclusion, in regard to the Theory of Legal Effectiveness and the Theory of Legal Certainty, the time limitation in formulating delegation rules is more likely to be implemented.
