"ABSTRAK
Since the signature of Law 31/2004 about Fishery and its revision through Law 45/2009, Indonesia had established 10 (ten) Fishery Courts. The first five, embedded in the distric courts of North Jakarta, Medan, Pontianak, Bitung, and Tual, were established on 2007; two, embedded in the distric courts of Tanjung Pinang and Ranai, were established on 2010; and the other three, embedded in the distric courts of Ambon, Sorong, and Merauke, were established on 2014. Originally intended to speed up the proceeding of illegal, unreported and unregulated (IUU) fishing; thes courts where instead considered taking too long to prosecute the perpetrators. As theresult, many illegal vessels were sunked without trial process. Quoting Susi Pudjiastuti Indonesia's current Maritime and Fisheries Minister it was done to cut the decision-making chain. One of the reasons behind this slow process is there are too many institutions involved in its criminal procedure. Therefore, this paper attempts to explain the regulatory framework of Indonesia fishery court including their procedural law and clarify the scope of authority possessed by each institution in charge of criminal procedure investigation, prosecution, and adjudication. Using secondary data (legal materials, books, dictionary, articles from legal journals, etc.), this paper will give light to the shortcomings of current fisherycourt and criminal procedure in Indonesia which can be used as evaluation materials for future revision."

"ABSTRAK
Tesis ini membahas mengenai penenggelaman kapal perikanan asing yang dilakukan oleh
pemerintah Indonesia sebagai upaya dalam memberantas IUU Fishing yang dikaji
berdasarkan hukum internasional. Penenggelaman kapal bertujuan untuk menunjukkan
pemerintah Indonesia dalam melindungi kedaulatan wilayah dan sumber daya alam yang
dimilikinya. Tesis ini membahas mengenai pengaturan hukum internasional dan hukum
nasional tentang IUU Fishing serta tentang penenggelaman kapal perikanan asing dan
praktek pelaksanaannya di Indonesia. Hasil dari penelitian ini adalah bahwa tindakan
penenggelaman yang dilakukan oleh pemerintah Indonesia telah sesuai dengan aturan
hukum nasional yaitu Pasal 69 ayat (4) Undang-Undang Perikanan, serta aturan
internasional yaitu UNCLOS 1982. Dalam UNCLOS 1982 memang tidak ada pengaturan
khusus secara spesifik tentang IUU Fishing. Namun terdapat ketentuan tentang yurisdiksi
pidana yang dapat diterapkan bagi kapal asing yang melakukan penangkapan ikan secara
illegal di wilayah kedaulatan negara seperti laut teritorial. Terhadap tindak pidana di
bidang perikanan yang terjadi di ZEE, dalam UNCLOS 1982, negara pantai memiliki hak
berdaulat yang eksklusif untuk melakukan eksplorasi dan eksploitasi sumber kekayaan
alam serta mengambil tindakan termasuk menaiki kapal, memeriksa, menangkap dan
melakukan proses peradilan, sebagaimana diperlukan untuk menjamin ditaatinya
peraturan perundang-undangan yang ditetapkannya

ABSTRACT
This thesis discusses the sinking of foreign fishing vessels conducted by the Indonesian
government as an effort in combating IUU fishing are assessed on the basis of international
law. The sinking of foreign fishing vessels aims to show that the Indonesian Government
is protecting its territorial sovereignty and its natural resources. This thesis discussed the
rules of international law and national law on IUU Fishing as well as about the sinking of
foreign fishing vessels and the practice of its implementation in Indonesia. The result of
this thesis is that the sinking actions conducted by the Indonesian Government is in accordance
with the rules sets in the national law, namely Article 69 paragraph (4) of the
Law of Fisheries, as well as international rules in UNCLOS 1982. In UNCLOS 1982, there
was no specific rules relating the IUU Fishing. However, there are provisions on criminal
jurisdiction that can be applied to foreign fishing vessels that performs illegal fishing in the
territorial sovereignty of the country such as the territorial sea. Relating to the fisheries
crime that occurred in the EEZ, the UNCLOS 1982 stated that a coastal state has sovereign
rights which are exclusive for the exploration and exploitation of natural resources
and take the necessary action, including boarding, inspection, arrest and do the judicial
process, as necessary to ensure the compliance of its legislation"
