Penyelesaian sengketa perdata pada tingkat upaya hukum banding, kasasi dan peninjauan kembali melalui perdamaian, sebagaimana yang diatur dalam pasal 21 dan pasal 22 Peraturan Mahkamah Agung No. 1 Tahun 2008 tentang Prosedur Mediasi di Pengadilan, tidak banyak menjadi pilihan penyelesaian sengketa perdata oleh para pihak yang bersengketa di Pengadilan. Sementara perdamaian pada tingkat upaya hukum banding, kasasi dan peninjauan kembali merupakan alternatif penyelesaian sengketa yang sederhana, cepat dan biaya ringan. Penelitian ini bersifat deskriptif dengan metode normatif atau doktrinal, yaitu dengan melihat bagaimana pengintegrasian mediasi sebagai bentuk penyelesaian sengketa dalam hukum acara perdata di Indonesia dalam menyelesaikan sengketa perdata pada tingkat upaya banding, kasasi dan peninjauan kembali. Ada beberapa kendala dalam pelaksanaan perdamaian pada tingkat upaya hukum dengan bantuan mediator di pengadilan negeri, sehingga para pihak yang berperkara lebih memilih berdamai di luar pengadilan dan mencabut perkara dalam upaya hukum banding, kasasi ataupun peninjauan kembali.

ABSTRACT
Settlement of civil disputes at the level of an appeal, appeal and review through peace, as stipulated in Article 21 and Article 22 of Indonesian Supreme Court Rule No 1/2008 on Procedures for Mediation in the Court, not a lot of choice of civil disputes by the parties to the dispute in court. While the peace at the level of an appeal, an appeal and a review of alternative dispute resolution is a simple, fast and low cost. This research is descriptive and normative or doctrinal methods, is to see how the integration of mediation as a form of dispute resolution in civil procedural law in Indonesia in settling civil disputes at the appeal, appeal and judicial review. There are several obstacles in the implementation of the peace at the level of legal action with the help of a mediator in the district court, so that the litigants would prefer to settle out of court and withdraw the case in an appeal, an appeal or reconsideration."

"Laporan magang ini menganalisis kasus sengketa pajak PT ADZA yang berkaitan dengan pengkreditan Pajak Masukan atas Price Deduction for Consumer. Sengketa pajak tersebut berawal dari hasil pemeriksaan yang menyatakan bahwa Pajak Masukan atas Price Deduction for Consumer pada tahun 2015 tidak dapat dikreditkan sehingga Direktorat Jenderal Pajak (DJP) menerbitkan Surat Ketetapan Pajak Kurang Bayar (SKPKB). Sengketa pajak yang sudah dalam proses banding di Pengadilan Pajak tersebut terjadi karena adanya perbedaan penafsiran dan pemahaman atas substansi transaksi Price Deduction for Consumer. Posisi PT ADZA dalam kasus ini lemah karena Faktur Pajak Masukan yang diterima dari lawan transaksi berasal dari transaksi yang seharusnya tidak terutang PPN. Berdasarkan analisis atas substansi transaksi dan kelengkapan Faktur Pajak Masukan, kasus sengketa pajak tersebut kemungkinan akan dimenangkan oleh DJP.

This internship report analyzes PT ADZA's tax dispute case related to the crediting of Input Tax on Price Deduction for Consumers. The tax dispute began with the results of an examination which stated that the Input Tax on Price Deduction for Consumers in 2015 could not be credited so that the Directorate General of Taxes (DGT) issued an Underpaid Tax Assessment Letter. The tax dispute, which is already in the process of being appealed to the Tax Court, occurred due to differences in interpretation and understanding of the substance of the Price Deduction for Consumer transaction. PT ADZA's position in this case is weak because the Input Tax Invoice received from the counterparty comes from a transaction that should not be subject to VAT. Based on the analysis of the substance of the transaction and the completeness of the Input Tax Invoice, the tax dispute case is likely to be won by the DGT."

"ABSTRACT
Penelitian dilakukan untuk mengetahui lembaga alternative penyelesaian sengketa manakah yang lebih efektif dalam menyelesaikan persengketaan antara konsumen dengan pelaku usaha di sektor jasa keuangan perbankan serta untuk mengetahui apakah dengan adanya kedua lembaga yang sama sama memiliki tugas untuk menyelesaikan sengketa tersebut akan timbulnya dualisme hukum. Penelitian dilakukan dengan metode yuridis normative, yaitu dengan melihat undang undang yang mengatur serta wawancara. Peneliti juga memperoleh data statistik yang didapat dari BPSK Prov. DKI Jakarta serta LAPSPI. Hasil penelitian ini menunjukan bahwa LAPSPI merupakan lembaga yang lebih efektif dalam menyelesaikan persengketaan di sektor jasa keuangan perbankan, serta tidak adanya dualisme hukum diantara kedua lembaga tersebut karena LAPSPI mengharuskan para pihak yang bersengketa di LAPSPI untuk membuat perjanjian yang menimbulkan adanya kompetensi absolut bagi LAPSPI untuk menyelesaikan sengketa tersebut. Namun dalam impelementasinya hal tersebut dirasa masih kurang maksimal karena menyebabkan ambiguitas dalam proses penyelesaian sengketa di sektor jasa keuangan perbankan. Dengan demikian, disarankan seharusnya kedua lembaga tersebut dapat bekerja sama  sehingga menciptakan kondisi hukum yang Efektif, Efisien, dan Bersinergi. Namun apabila hal tersebut sulit untuk diwujudkan maka diperlukannya sosialisasi yang lebih baik dari LAPSPI serta dibentuknya peraturan pelaksana yang lebih tegas oleh pemerintah terhadap kedua lembaga tersebut.

ABSTRACT
This research is conducted to further obtain which alternative dispute resolution institutions were more effective in resolving disputes between consumers and business person form the financial services sektor on banking, and to find out whether the existence of the two institutions that had the same task which to resolve the dispute can cause legal dualisme. This research is conducted with normative juridical method, by looking at the governing law and by interview. Researcher obtained the statistical data from Consumer Dispute Resolution Body (BPSK) and Alternative Body for Dispute Settlement in Banking of Indonesia (LAPSPI). The results of this study indicate that LAPSPI is a more effective institution in resolving disputes in the banking financial services sektor, and there was no legal dualisme between the two institutions because LAPSPI requires the parties to make an agreement which creates absolute competence for LAPSPI to resolve the dispute. However, the implementation of this matter were still not optimal because it caused ambiguity in the dispute resolution process in the banking financial services sector. Furthermore, it is recommended that the two institutions to work together to make an Effective, Efficient, and Synergic legal condition. However, if that is difficult to be realized then the need for better socialization from LAPSPI is needed, Also the establishment of  more resolute implementing agreement by the government on both Institutions. "
