"Dalam penelitian ini terdapat dua pokok permasalahan, yaitu Pertama, berkaitan dengan kedudukan hukum Undang-Undang yang Meratifikasi Perjanjian Internasional dalam sistem hukum nasional Indonesia, dan Kedua, mengenai pengujian Undang-Undang yang meratifikasi perjanjian internasional tersebut terhadap UUD NRI 1945 dengan menganalisis Putusan MK No. 33/PUU-IX/2011 tentang Pengujian Undang-Undang Nomor 38 Tahun 2008 Tentang Pengesahan Piagam Asean. Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang menggunakan data sekunder dan disajikan secara deskriptif analitis. Hasil penelitian menunjukan bahwa tata urutan peraturan perundang-undangan menurut UU No. 12 Tahun 2011 tidak melakukan pembedaan kedudukan hukum undang-undang yang meratifikasi perjanjian internasional dengan undang-undang pada umumnya. Apabila dikaitkan dengan wewenang Mahkamah Konstitusi untuk menguji konstitusionalitas suatu undang-undang, maka Mahkamah Konstitusi berwenang menguji undang-undang yang meratifikasi perjanjian internasional.

This research focus on two main problems. First, the legal position of the Ratification of Treaties Act in Indonesian legal system. Second, Ratification of Treaties Act review toward UUD NRI 1945 by Constitutional Court by analyzing Constitutional Court Verdict No. 33/PUU-IX/2011 on Law No. 38 year 2008 on Ratification of Asean Charter. The method used in this research is judicial-normative, using secondary data, this research will also be presented in the form of descriptive-analytical.

The result shows that Law No. 12 year 2011 which regulates the hierarchy of legal norms not distinguish the legal position of ratification of treaties act and law in general. Regarding to Constitutional Court competence to review any Law alleged to be in conflict with the Constitution, therefore Constitutional Court has competence to review ratification of treaties act."
