"Skripsi ini meninjau secara Yuridis dan Sosiologis terhadap Mahasiswa peraih beasiswa yang bekerja Paruh Waktu di Fakultas Hukum Universitas Indonesia. Dengan bekerjanya mahasiswa S1 Fakultas Hukum Universitas Indonesia yang juga sebagai penerima beasiswa, suatu aturan diperlukan untuk mengakomodasi dan mengatur guna menghindari timbulnya persoalan-persoalan dalam proses kegiatan akademik perkuliahan dan kegiatan pekerjaan paruh waktu. Hasil penelitian yang dilakukan dengan penelitian yuridis sosiologis melalui pendekatan perundang-undangan statutory approach dan perbandingannya comparative approach dengan penerapan di masyarakat juga wawancara tujuh narasumber dan lima informan menunjukkan bahwa adanya penerapan secara sosiologis dari Peraturan Akademik di Universitas Indonesia, Peraturan beasiswa di Lembaga Pemerintah dan Lembaga Swasta, dan Peraturan di Lembaga Tempat Kerja Mahasiswa. Selain itu juga menunjukkan adanya aspek psikologis yang mendasari mahasiswa yang mendapat beasiswa memutuskan untuk bekerja paruh waktu dengan menentukan standar tertinggi dari pilihan yang mereka miliki.

This thesis observes Law Student who had part time job at Faculty of Law University of Indonesia from the perspective of Juridical and Sociological. Student did part time work also as an awardees, a law is needed to accommodate and regulate the problem between their academic activities and their part time jobs. This research is based on the Sosciological and juridical statutory approach with comparison to other regulations comparative approach . Based on the research method, this thesis is used an approach based on sociological research throughout the study of empirical studies and also interviews made to seven resource persons and five informants. The results shows that there is a sociological basis of the Academic Regulation at the University of Indonesia, scholarship regulations, as well as from their working place rsquo s regulation. It also shows the psychological aspect of the students who received scholarships about how they finally decide to work on part time basis and also about how they determine the choice which reflect their highest priority.

Nama:Bartho Nahot BanjarnahorNPM:15067800001Program Studi:Magister HukumJudul:Penyelesaian Perselisihan Pemutusan Hubungan Kerja Dengan Alasan Pelanggaran Berat Pasca Putusan MK No. 12/PUU-I/2003Sebelum lahirnya putusan MK No. 12/PUU-I/2003, pelanggaran berat atau tindak pidana yang dilakukan pekerja dalam hubungan industrial dapat langung dilakukan pemutusan hubungan kerja setelah pengusaha memiliki bukti-bukti yang cukup, akan tetapi Putusan MK No. 12/PUU-I/2003 menyatakan Pasal 158 UU 13 Tahun 2003 tersebut tidak mempunyai kekuatan hukum mengikat. Permasalahan dalam tesis ini adalah : 1 bagaimana praktek penyelesaian perselisihan pemutusan hubungan kerja dengan alasan kesalahan berat diperusahaan anggota DPN Apindo, pengalaman serikat pekerja/serikat buruh, dan perspektif pemerintah sebagai regulator pasca putusan Mahkamah Konstitusi No. 12/PUU-I/2003, 2 . bagaimana perusahaan mengatur pemutusan hubungan kerja apabila terjadi kesalahan berat eks Pasal 158 UU Ketenagakerjaan di dalam perusahaan, setelah putusan Mahkamah Konstitusi No. 12/PUU-I/2003, dan 3 . Bagaimana putusan Mahkamah Agung menyelesaikan perselisihan pemutusan hubungan kerja dengan alasan kesalahan berat pasca putusan Mahkamah Konstitusi No. 12/PUU-I/2003 tersebut. Untuk menjelaskan pertanyaan-pertanyaan tersebut, tesis ini menggunakan metode penelitian yuridis normatif. Hasil penelitian ini menunjukkan Perusahaan Anggota DPN Apindo terdapat perusahaan yang mengatur pelanggaran berat dalam ketentuan internal maupun yang tidak mengatur, pemerintah sendiri telah mengeluarkan Surat Edaran untuk pelaksanaan Putusan MK ini, sedangkan bagi buruh PHK tidak sejalan dengan Konstitusi. Hasil lainnya adalah, perusahaan anggota DPN Apindo menyelesaikan pemutusan hubunga kerja eks Pasal 158 UU Ketenagakerjaan dengan proses bipartit yang jika tidak sepakat, sebahagian menggunakan mekanisme UU No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, dan sebahagian lain menggunakan pendekatan pidana, akan tetapi juga ada perusahaan yang langsung menggunakan pendekatan pidana tanpa perundingan bipartit. MA memutus perkara PHK pelanggaran berat dengan memperhatikan ketentuan internal perusahaan.

The problems in this thesis are 1 How is the practice of settlement of disputes for termination of employment by reason of grave wrongdoings in DPN Apindo 39 s company members, union labor union experience, and government perspective as regulator after the Constitutional Court 39 s decision No. 12 PUU I 2003 is applied 2 . How does the company regulate the termination of employment in case of grave wrongdoings in Article 158 of the Manpower Law within the company, after the decision of the Constitutional Court No.12 PUU I 2003 and 3 . How does the Supreme Court 39 s decision resolve the dismissal dispute with the reasons of grave wrongdoings after the decision of the Constitutional Court No. 12 PUU I 2003. To explain these problems, this thesis uses normative juridical research methods. The result of this study shows that DPN Apindo 39 s company members have companies that regulate serious violations in internal or non regulatory provisions meanwhile the government itself has issued a Circular Letter for the implementation of this Constitutional Court Decision, while for the workers, termination of employment are not in line with the Constitution. Another result is that DPN Apindo 39 s company members have completed the termination of the former labor relations of Article 158 of the Manpower Law with bipartite process which, if it is unanimous, partly uses the mechanism of Law no. 2 of 2004 on Industrial Relations Dispute Settlement, and partly uses a criminal approach, but there are also companies that directly use a criminal approach without bipartite negotiations. The Supreme Court adjudicated cases of termination of employment breaches by taking into account of the internal provisions of the company. "
