"Kepastian dan perlindungan hukum adalah hak yang harus diperoleh pekerja dalam melakukan hubungan kerja. Pelanggaran terhadap Perjanjian Kerja Waktu Tertentu (PKWT) oleh perusahaan menjadi salah satu bentuk perselisihan hak dalam hubungan industrial yang memberikan ketidakpastian hukum bagi pekerja. Fokus penulisan skripsi ini adalah analisis pertimbangan hakim pada Putusan Pengadilan Hubungan Industrial di Pengadilan Negeri Palembang Nomor 114/Pdt.Sus-PHI/2023/PN.Plg dalam memberikan kepastian dan perlindungan hukum bagi pekerja dengan status PKWT Berkelanjutan yang tidak sesuai dengan peraturan perundang-undangan di bidang ketenagakerjaan. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis-normatif yang menggunakan studi kepustakaan. Pendekatan metode penelitian yang digunakan dalam penelitian ini adalah kualitatif dengan studi kasus. Hasil penelitian ini menunjukkan bahwa kepastian dan perlindungan hukum yang diperoleh pekerja erat kaitannya dengan peran pengawas ketenagakerjaan dan para penegak hukum dalam memastikan hukum ketenagakerjaan diterapkan sebagaimana mestinya.

Legal certainty and protection are rights that workers must obtain in an employment relationship. Breaches of Fixed-Term Employment Agreement by a company become rights disputes in industrial relations that cause legal uncertainty for workers. Focus of this thesis is to analyze the legal consideration of the judges on Industrial Relations Court in Palembang Court Decision Number 114/Pdt.Sus-PHI/2023/PN.Plg in giving legal  certainty and protection for  Workers with Continuous Fixed-Term Employment Agreement that are not in accordance with the labor regulations. The research method used in this research is juridical-normative using literature study. The approach of the research method used is qualitative with case studies. The result of this thesis shows that the legal certainty and protection obtained by workers is closely related to the role of labor inspectors and law enforcers in ensuring that labor laws are implemented properly. "

"Indonesian economy has grown significantly for the past quarter of
century. However; welfare of the labors are still in a poor condition This was
indicated by their wages which only around the minimum wages, even after the
government of Indonesia raised them several times. In the era of globalization
or in a borderless economic framework, factors of productions become more
mobile. Mobility of both capital and labor could be driven by comparative
advantages of local and regional markets. When the wage IE' too low
domestically, and when there is a high demand for low-skill workers abroad,
tlte labor will migrate to higher-wage countries. On the other hands, when the
wage is too high in indonesia, foreign investors who invest in footloosee
industries may relocate their industries to lower-wage countries. In addition,
employer can cut down employment to reduce production cast if the wages are
too high. Titus, the scissor effects have to be dealt wisely. Increasing minimum
wages is not the only way to increase worker's welfare. Improving the
_productivity of the labor through formal and informal education is an indirect
way of raising the welfare of workers. Considering that the quality of
Indonesia's labor is still very low and the fact that factors of production are
more mobile in this globalization era, improving the quality of workers to be
more competitive globally is seen as a key situation to the problem.

"Penelitian ini bertujuan untuk melihat besarnya kesenjangan penghasilan antar gender para wirausaha dan pekerja dengan menggunakan metode dekomposisi Blinder-Oaxaca. Metode ini membagi penyebab kesenjangan penghasilan antar gender menjadi dua bagian, yaitu faktor endowment yang dijelaskan oleh variabel umur, pendidikan, tempat tinggal, jam kerja, status kegiatan, jenis pekerjaan, dan lapangan usaha, serta faktor diskriminasi. Dari data Sakernas Agustus 2013, ditemukan bahwa kesenjangan penghasilan antar gender para pekerja lebih besar dibandingkan para wirausaha. Kontribusi faktor endowment lebih besar dalam menjelaskan kesenjangan penghasilan antar gender para pekerja, sedangkan kontribusi faktor diskriminasi lebih besar dalam menjelaskan kesenjangan penghasilan antar gender para wirausaha.

This research aims to find out the gender earnings gap in self and wage employment using Blinder-Oaxaca decomposition method. This method divides the causes of the gender earnings gap into endowment factor which is explained by age, education, residence, working hours, activity status, occupation and industry, as well as discrimination factor. Using Sakernas August 2013, it is found that the gender earnings gap in wage employment is greater than self employment. Endowment factor contribution is bigger in explaining the gender earnings gap in wage employment, while discrimination factor contribution is bigger in explaining the gender earnings gap in self employment."
