"Sebagaimana yang tercantum di dalam UUD 1945 pasal 28D ayat (2) yang berbunyi Setiap orang berhak untuk bekerja serta mendapatkan imbalan dan perlakuan yang adil dan layak dalam hubungan kerja. Ayat tersebut dapat dijadikan dasar bahwa setiap orang berhak untuk bekerja, Manusia sendiri sebagai makhluk ekonomi bertindak sebagai agen yang melakukan tindakan ekonomi untuk memenuhi kebutuhannya. Salah satu bentuk pemenuhan kebutuhan tersebut adalah dengan melakukan usaha. Bentuk usaha perseorangan merupakan bentuk badan usaha yang paling tua dan paling umum digunakan oleh para pengusaha sebagai sarana menjalankan kegiatan usaha. Dalam skripsi ini Penulis mengangkat rumusan masalah bagaimana pengaturan mengenai Perusahaan Perseorangan di Indonesia dan dalam skripsi ini Penulis menggunakan sampel sebuah perusahaan perseorangan bernama restoran S. Sehingga rumusan masalah yang kedua adalah bagaimana praktik Restoran S sebagai Perusahaan Perseorangan dengan hukum yang berlaku di Indonesia saat ini. Penelitian ini menggunakan metode penelitian hukum yuridis-normatif. yang mana hasil hasil dari skripsi ini dapat disimpulkan Belum adanya ketentuan yang mengatur secara khusus mengenai Perusahaan Perseorangan.

As stated in Undang-Undang Dasar 1945 article 28D paragraph (2) which said Every person has the right to work and to get fair and proper compensation and treatment in an employment relationship. The verse can be used as the basis that everyone has the right to work, Human himself as an economic being acts as an agent who takes economic action to meet their needs. One form of meeting these needs is to do business. The form of Sole Proprietorship is the oldest and most commonly used form of business entity as a means of carrying out business activities. In this thesis I raise the formulation of the problem of how to regulate the Sole Proprietorship in Indonesia and in this thesis I use a sample of an individual company called Restaurant S. So the second problem formulation is how the practice of Restaurant S as a Sole Proprietorship with the applicable law in Indonesia today. This study uses a juridical-normative legal research method. which results from this thesis can be concluded There is no provision that specifically regulates the Sole Proprietorship."
