"Pemanfaatan sistem pesawat tanpa awak berupa drone kini telah berkembang di berbagai bidang, salah satunya bidang komersial yaitu penggunaan drone dalam kegiatan pengiriman barang. Beberapa negara di dunia telah membuat drone yang dapat digunakan secara eksplisit dalam kegiatan pengiriman barang ini dan telah mengaturnya dalam undang-undang nasional negara masing-masing. Hal ini mendorong ICAO sebagai organisasi penerbangan sipil internasional untuk berperan dalam memberikan regulasi terkait hal tersebut dan menyelaraskan aturan yang ada di beberapa negara agar tidak melanggar aturan mengenai keselamatan dan keamanan penerbangan secara umum. Berdasarkan penelitian yang telah dilakukan, penulis menemukan bahwa drone tidak terbatas pada bidang militer dan rekreasi. Drone telah berkembang menjadi sarana pengiriman barang di berbagai negara. Hal ini dikarenakan drone memiliki poin lebih dibandingkan bentuk transportasi lainnya. Namun, selain beberapa kelebihan yang ada, drone memunculkan beberapa permasalahan hukum terkait pengoperasian drone sebagai sarana pengiriman barang, yaitu terkait dengan keamanan dan keselamatan penerbangan secara umum. Sebagai otoritas tinggi yang mengatur penerbangan sipil dunia dan mengakomodasi perkembangan teknologi penerbangan yang semakin pesat berkembang menjadi komersial, ICAO telah memberikan model regulasi yang dapat digunakan negara-negara anggota sebagai acuan dalam penyusunan peraturan terkait hal ini di negaranya masing-masing. Indonesia sebagai salah satu negara anggota ICAO telah memiliki beberapa peraturan terkait pengoperasian sistem drone melalui beberapa undang-undang dan peraturan menteri terkait. Namun, Indonesia belum memiliki aturan yang komprehensif terkait pengiriman barang dengan menggunakan drone.
The use of unmanned aircraft systems in the form of drones has now developed in various fields, one of which is the commercial field, namely the use of drones in goods delivery activities. Several countries in the world have made drones that can be explicitly used in this goods delivery activity and have regulated this in the national laws of their respective countries. This has encouraged ICAO as an international civil aviation organization to play a role in providing regulations related to this matter and to harmonize existing rules in several countries so that they do not violate the rules regarding aviation safety and security in general. Based on the research that has been done, the authors found that drones are not limited to the military and recreational fields. Drones have developed into a means of shipping goods in various countries. This is because drones have more points than other forms of transportation. However, in addition to some of the existing pluses, drones raise several legal problems related to the operation of drones as a means of delivering goods, which are related to aviation security and safety in general. As the high authority that regulates world civil aviation and accommodates the development of aviation technology which is increasingly rapidly expanding into commercial, ICAO has provided a regulatory model that member countries can use as a reference in drafting regulations related to this matter in their respective countries. Indonesia, as one of the ICAO member countries, already has several regulations related to the operation of drone systems through several laws and related ministerial regulations. However, Indonesia does not yet have comprehensive rules regarding drones delivering goods."

"For civil aviation to progress it has never been just about technology and business practices. To go from the rudiments of the early services that plied across short distances in Europe and America to what we experience today required most of all that politicians and policy-makers address the central problems of national sovereignty over air space and national ownership and control over airlines. Those problems have plagued the development of seamless and efficient air services for consumers in the international sphere. One would have thought that international airlines might have led the way towards a uniform globalized system given the nature of their enterprise, but that has definitely not been the case. Sovereignty and security issues have more often than not trumped commercial arguments for a more level playing field for international airlines. There has thus been an on-going tussle between sovereignty, state security and mercantilist practices on the one hand and the ambition for civil aviation to flourish on the other. As one early commentator put it:’ one is convinced that the sovereign state cannot be left without authority over what happens just above its territory, (but) … one shrinks from the idea that aerial navigation could be the object of narrow-minded restrictions.’ How those narrow-minded restrictions were gradually eroded, though still not eliminated, to enable civil aviation to flourish is at the heart of this work.
This book will be of direct interest to students of aviation, modern history, international relations and transport. It is also of value to airline industry professionals and government transport departments."

"Keselamatan penerbangan salah satunya ditentukan oleh pengiriman kargo dan pos. Sehingga diperlukan pemeriksaan terhadap keamanan kargo dan pos. Salah satu pelaksana untuk pemeriksaan keamanan tersebut adalah regulated agent. Tesis ini membahas bagaimana hubungan hukum antara regulated agent dengan badan usaha angkutan udara dalam melakukan pemeriksaan keamanan kargo dan pos; dan tanggungjawab hukum regulated agent apabila terjadi kesalahan pemeriksaan kargo dan pos menurut Standar International Civil Aviation Organization (ICAO) dan Undang-Undang Nomor 1 tahun 2009 tentang Penerbangan. Hasil penelitian yang menggunakan metode yuridis normatif ini, menunjukkan bahwa hubungan hukum antara regulated agent dengan badan usaha angkutan udara adalah hubungan hukum pemberian kuasa atau agency law. Hal ini karena regulated agent melakukan pemeriksaan keamanan kargo dan pos untuk kepentingan badan usaha angkutan udara berdasarkan (perjanjian) kerjasama. Adapun badan usaha angkutan udara adalah badan yang berwenang untuk menjaga keselamatan penerbangan udara. Terkait dengan tanggung jawab regulated agent apabila terjadi kesalahan pemeriksaan keamanan kargo dan pos, baik dalam ICAO maupun undang-undang penerbangan, tidak secara tegas mengatur tanggung jawab regulated agent. Namun demikian, beberapa ketentuan di kedua aturan tersebut, dapat diketahui bahwa dalam hal terjadi kesalahan pemeriksaan maka yang bertanggungjawab adalah pengangkut, dalam hal ini badan usaha angkutan udara di Indonesia dan aircraft operator di ICAO."
