"ABSTRAK
The development of the manufacturing industry is one of the standards for Indonesia's development as a developing country. Domestic investment (DI) and foreign direct investment (FDI) can meet investment needs in this industry. This paper focuses on the nexus of the two types of investment in meeting investment needs in the manufacturing industry and the influence of those investments in relatively capital-intensive and relatively labor-intensive industrial groups. The aim is to evaluate the role of both types of investments and their benefits to the economy not only to the value-added but also in transferring technology and knowledge spillover from FDI to DI. The panel data regression was first to do to observe the differences between groups of relatively capital-intensive industrial samples and relatively labor-intensive industrial samples. The comparison results show that there are significant differences between the two industry groups so that it can be regressed on these two sample types, apart from the regression of the overall sample. The overall sample found that both FDI and DI influence the value-added of the manufacturing industry."

"ABSTRAK
Perubahan Anggaran Dasar Induk Perusahaan Penanaman Modal Dalam Negeri Menjadi Penanaman Modal Asing menimbulkan implikasi yuridis karena status induk perusahaan berubah dari perseroan terbatas penanaman modal dalam negeri menjadi perseroan terbatas penanaman modal asing, hal ini berpengaruh terhadap anak perusahaan dan terdapat implikasi perubahan status induk perusahaan terhadap anak perusahaan apabila kegiatan usaha anak perusahaan merupakan sektor yang tertutup untuk asing atau melebihi batas persentase yang diperbolehkan untuk asing. Penulisan tesis ini dikaji berdasarkan metode yuridis normatif yang menekankan pada norma-norma hukum dengan menganalisa peraturan perundang-undangan terkait tentang penanaman modal dan perusahaan serta peraturan perundang-undangan lain yang mendasarinya. Hasil penelitian menunjukan bahwa pengaruh atas berubahnya status induk perusahaan dari Perseroan Terbatas Penanaman Modal Dalam Negeri menjadi Perseroan Terbatas Penanaman Modal Asing yaitu perubahan status anak perusahaan menjadi penanaman modal asing berdasarkan Pasal 1 angka 8 Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal karena terdapat unsur modal asing yang masuk ke dalam perseroan tetapi induk perusahaan tersebut tidak termasuk dalam penanam modal asing sebagaimana dimaksud dalam Pasal 1 angka 6. Implikasi perubahan status induk perusahaan terhadap anak perusahaan apabila kegiatan usaha anak perusahaan merupakan sektor yang tertutup untuk asing atau melebihi batas persentase yang diperbolehkan untuk asing sebagaimana diatur dalam Peraturan Presiden Nomor 44 Tahun 2016 Tentang Daftar Bidang Usaha yang Tertutup dan Bidang Usaha yang Terbuka Dengan Persyatatan Di Bidang Penanaman Modal yaitu timbul kewajiban untuk melakukan pengalihan saham kepada orang perorangan Warga Negara Indonesia atau badan hukum Indonesia yang kepemilikan sahamnya tidak ada unsur modal asing sebagaimana dimaksud dalam berdasarkan Pasal 1 angka 8 UUPM. Hal lain yang dapat dilakukan adalah penyesuaian mengenai bidang usaha, dimana anak perusahaan dapat melakukan perubahan bidang usaha yang sesuai.

ABSTRACT
Amendment of Article of Association Domestic Capital Investment Holding Company Becomes Foreign Capital Investment raised legal implication because of holding company status changed from Article of Association Domestic Capital Investment Holding Company Becomes Foreign Capital Investment, it affects to subsidiary and there is implication because of holding company status has changed to the subsidiary if subsidiary business sector are closed of foreign investor or maximum percentage allowed for foreign investment. Writing method uses is a normative legal research method and data used is primary data. The result show the impact because of holding company status changed from Domestic Capital Investment Holding Company Becomes Foreign Capital Investment is subsidiary company should be change become foreign investment based on Article 1 Point 8 Law Of The Republic Of Indonesia Number 25 Of 2007 Concerning Investments because there is foreign capital as mentioned in Article 1 Point 6. Implication of holding company status has changed to the subsidiary if subsidiary business sector are closed of foreign investor or maximum percentage allowed from foreign investment pursuant to Presidential Regulation No. 44 of 2016 regarding the List of Business Fields That Are Closed and Business Fields That Are Conditionally Open for Investment is should assign their share to Indonesian citizen s or Indonesian legal entity ies which is there is no foreign capital as mentioned in Article 1 Point 8. Another way, the subsidiary should change their business field."

"ABSTRAK
Tesis ini membahas tentang pengaruh dari foreign investment portfolio terhadap domestic stock return di Indonesia periode sebelum dan sesudah krisis. Untuk mengukur adanya pengaruh foreign investmentportfolio maka sampel penelitian dibagi menjadi Favored dan Unfavored Group asing, kemudian metode yang digunakan adalah metode pendeteksian herding dengan CSAD. Kemudian hasil dari pengukuran herding ini digunakan untuk melihat adanya superior return yang lebih baik dari favored group dibandingkan dengan unfavored group dengan menggunakan CAPM-GARCH. Penelitian ini menunjukan bahwa adanya indikasi herding behavior pada saat pasar sedang naik, pada sebelum dan sesudah krisis, dan favored group asing memeberikan superior return pada saat sebelum dan sesudah krisis.

ABSTRAK
This study discusses the influence of foreign investment portfolio towards domestic stock returns in Indonesia, before and after the crisis periods. The sample is devided into favored group and unfavored group, in order to see the influence of foreign investment portfolio. Then the performance of two groups is compared by using CSAD to measure herding behavior. The Result from CSAD used to compare superior return from foreign favored group using CAPM-GARCH. This study showsthere is herding behavior in favored group and unfavored group when the market up, before and after the crisis, and foreign group favored rewards the investor with superior return before and after the crisis periods."

"This book brings together foreign investment and investment arbitration in Asia, the fastest growing economic region in the world. It provides a critical analysis of foreign investment, its benefits and the legal regimes of the jurisdictions studied at a time when investor-state disputes are on the rise and investment arbitration is under growing scrutiny. Governments are under greater pressure to balance the promotion of investment with public policy development and interests and calls for a permanent court for investment arbitration are getting louder. To assess future possibilities, this book takes stock of, brings together and analyses the legal regimes on foreign investment in 12 major Asian jurisdictions, namely China, Hong-Kong, India, Indonesia, Japan, South Korea, Malaysia, Myanmar, Philippines, Singapore, Thailand and Vietnam. These constitute paradigmatic examples of what is happening in the legal framework of Asian foreign investment and the impact that the current system of investment arbitration has in all of them. The analysis shows the existence of changing positions and degrees of openness towards foreign investment in the region, as well as a distinct level of exposure to and involvement in investment arbitration. Predictably, their situation will change in the near future, at least in relation to investment arbitration. Proposals for reform have already been made and international institutions are working on the development of an alternative to the proceedings of investment arbitration as it is currently constructed and understood. Consequently, the last two chapters of this book are devoted to the analysis of these developments that will most probably affect the existing situation in the region."

"Studi ini bertujuan untuk mencari chanel yang menghubungkan antara FDI dan pertumbuhan ekonomi di Indonesia dari sektor manufaktur, sektor nonmigas dan semua sektor ekonomi di Indonesia dengan menggunakan pendekatan Kausalitas Granger. Tes ini akan dilaksanakan dalam kerangka kointegrasi dan vektor model koreksi kesalahan. Temuan menunjukkan bahwa ada kausalitas satu arah dari FDI terhadap PDB, namun, ekspor dan investasi domestik tidak dapat diperlakukan sebagai chanel di mana FDI bisa menguntungkan pertumbuhan ekonomi di Indonesia. Hasil penting lain menegaskan bahwa ada kausalitas dari PDB untuk FDI di Indonesia, di mana ekspor dan domestik dapat diperlakukan sebagai chanel yang menghubungkan antara PDB ke FDI. Hasil ini memiliki implikasi kebijakan yang penting bagi pemerintah Indonesia, seperti pemerintah harus fokus pada ekonomi domestik ketimbang promosi ekspor, mengelola stabilitas makroekonomi dan memberikan perhatian pada ekspor dan investasi dalam negeri untuk menarik FDI.

This study investigates various channels through which FDI could benefit economic growth in Indonesia from manufacture sector, non-oil sector and all economic sectors in Indonesia by using Granger Causality approach. This test will be implemented within a cointegration framework and vector error correction model. The findings show that there is a unidirectional causality from FDI to GDP, however, export and domestic investment cannot be treated as the channel through which FDI could benefit economic growth in Indonesia. Another important result confirms that there is causality from GDP to FDI in Indonesia, thus export and domestic investment can be treated as the passage. These findings have important policy implications such as the Indonesia government should focus in domestic economy rather than exports promotion; manage the macroeconomic stability and give attention in exports and domestic investment to attract FDI.
