"UNCLOS mengakui bahwa negara pantai mempunyai hak berdaulat atas zona ekonomi eksklusif (ZEE) dan landas kontinen, oleh karena itu negara pantai berkewajiban mengatur, mengizinkan, dan melakukan aktivitas kelautan di wilayah tersebut, termasuk Marine Scientific Research (MSR). UNCLOS memberikan diskresi kepada negara pantai untuk memberikan izin atas MSR yang dilakukan oleh pihak asing, sekaligus mewajibkan negara pantai untuk menjamin persetujuan atas permohonan MSR oleh pihak asing yang dilakukan dalam keadaan normal yang bertujuan damai dan untuk peningkatan pengetahuan akan laut. Sejalan dengan perkembangan teknologi, aktivitas MSR yang dilakukan tidak terbatas pada riset fundamental yang bertujuan bagi pengetahuan akan laut, namun juga riset terapan yang berpotensi menghasilkan suatu yang bernilai ekonomi. Dalam skripsi ini akan dibahas perkembangan MSR oleh pihak asing, pengaturan UNCLOS mengenai MSR, juga praktik dan hukum nasional Kanada, Tiongkok, Kenya, dan Indonesia mengenai MSR oleh pihak asing di ZEE dan landas kontinennya.

UNCLOS recognized that Coastal State has sovereign right over exclusive economic zone and continental shelf, thus Coastal State has the obligation to regulate, authorize and conduct the marine activities in such territory, including Marine Scientific Research (MSR). UNCLOS give Coastal State the discretion to issue a permit of foreign MSR, while at the same time obliged Coastal State to give the permit of foreign MSR in normal circumstances for peaceful purposes and in order to increase scientific knowledge of marine environment. Along with technology development, MSR activities are not limited to fundamental researched aiming for marine knowledge, but also applied research with economic potential. This study discusses the development of foreign MSR, the regulation of MSR under UNCLOS, the practice and the regulation of Canadian, Chinese, Kenyan and Indonesian Law with regard to foreign MSR in EEZ and Continental Shelf.
