"Skripsi ini meneliti mengenai pengaturan terkait dengan inseminasi donor sebagai suatu tindakan reproduksi berbantu di Indonesia dan Negara Bagian Indianapolis, Amerika Serikat. Secara khusus, skripsi ini juga akan meneliti mengenai tanggung jawab hukum dari dokter terhadap suatu tindakan reproduksi berbantu apabila terjadi suatu pelanggaran di mana seorang dokter memasukkan spermanya sendiri dalam tindakan reproduksi berbantu tanpa persetujuan pasien hingga menghasilkan kurang lebih 90 orang anak, seperti yang dilakukan oleh Dokter Donald Cline di Negara Bagian Indianapolis. Kasus Dokter Donald Cline merupakan salah satu kasus reproduksi berbantu yang cukup terkenal mengingat beliau merupakan salah satu dokter fertilitas terbaik di Indiana pada masanya. Akan tetapi, para korban dari Cline menganggap bahwa pertanggungjawaban hukum yang dilakukan oleh Cline tidak setimpal dengan perbuatannya, dan hal ini didasari oleh adanya suatu kekosongan hukum di Negara Bagian Indianapolis saat itu. Dalam melakukan penelitian, peneliti menggunakan metode penelitian doktrinal dengan tipologi preskriptif. Permasalahan dalam skripsi ini adalah apabila terjadi suatu kasus dimana seorang dokter memasukkan spermanya sendiri dalam tindakan reproduksi berbantu tanpa persetujuan pasien, bagaimanakah pertanggungjawaban hukum atas hal tersebut. Selain itu, permasalahan dalam skripsi ini juga bagaimana kasus Donald Cline jika dilihat dari sudut pandang hukum Indonesia, sebagai bentuk pencegahan apabila hal serupa terjadi di Indonesia. Kesimpulan atas permasalahan tersebut adalah jika kasus Donald Cline terjadi di Indonesia, sesuai dengan hukum yang berlaku di Indonesia saat ini, dokter dapat dimintakan pertanggungjawaban secara administratif, perdata, dan pidana.

This thesis examines the regulation related to donor insemination as an act of assisted reproduction in Indonesia and Indianapolis, United States. In particular, this thesis will also examine the legal responsibility of a doctor for an act of assisted reproduction if there is a violation where a doctor inserts his own sperm in an act of assisted reproduction without the patient's consent and produce approximately 90 children, as done by Doctor Donald Cline in Indianapolis. The case of Doctor Donald Cline is one of the most famous fertility fraud cases considering he was one of the best fertility doctors in Indiana during his time. However, the victims of Cline considered that the legal liability of Cline was not commensurate with his actions, and this was based on the nonexistence of a legal basis to judge Cline in at that time. In conducting the research, the researcher used doctrinal research method with prescriptive typology. The problem in this thesis is if there is a case where a doctor inserts his own sperm in assisted reproduction without the patient's consent, how is the legal liability for this. In addition, the problem in this thesis is also how the Donald Cline case if seen from the perspective of Indonesian law, as a form of prevention if something similar happens in Indonesia. The conclusion of the problem is that if the Donald Cline case occurs in Indonesia, in accordance with the current law in Indonesia, doctors can be held liable administratively, civilly, and criminally."

"ABSTRAKHak reproduksi merupakan bagian dari hak asasi setiap manusia. Bagipasangan menikah, hak reproduksi harus dipenuhi dalam kondisi dasar consent(bebas, tidak ada paksaan), equality (tidak ada dominasi), respect (salingmenghormati), Jrust (saling percaya/jujur), and saftty (aman).Penelitian ini dilakukan dalam bentuk studi kasus untuk mendapatkangambaran tentang pemenuhan hak reproduksi perempuan muslim menikah padaberbagai tahapan usia perkawinan. Desain penelitian yang digunakan adalah studikasus dengan menggunakan motoda pengumpulan data wawancara mendalam.lnforman penelitlan melibatkan 6 (enam} muslimah dan suami serta beberapakerabat dan tetangga informan. Penelitian ini dilakukan sejak Nopember 2007hingga Desember 2008.Dengan menggunakan Theory af Reasoned Action, hasil temuan daripenelitian ini dapat menjelaskan bahwa, tidak satupun infonnan benar-benarterpenuhi hak reproduksinya dalam kondisi CERTS. Niat untuk memenuhi hakreprodoksi sangat dipengaruhi oleh sikap sebagai faktor internal dan normasubjektif, yaitu persepsi terhada.p orang lain sebagai fak:tor eksternal. Banyaknyaorang yang mempengaruhi nonna subjektlf informan kemudian diseleksi,sehlngga hanya orang tertentu yang dipatuhi. Ancaman tetjadinya pemikahantanpalkurang hubungan seks dapat terjadi setelah lahirnya anak pertama.Temuan lain adalah, kedudukan dan keputusan suami selalu mendominasidalam berbagai hal pemenuhan hak reproduksi. Sedangkan ternan dan petugaskesehatan dapat memperbesar pengarutmya terhadap norma subjek.tif istri jika iasendiri aktif dan kritis mencari informasi dan mengupayakan tercapainya kondisikesehatan reproduksi. Dalam hal penggunaun alat kontrasepsi pada pasangan yangbelum/tidak lagl menginginkan anak dalarn waktu dekat, hanya dilakukan olehpihak istri. Suami umumnya pemah mencoha menggunakan kondom, tetapim_erasa tidak nyaman. Pihak istri menggunakan alkon {pH. spiral. atau implan)dengan risiko mengalami etek samping tidak menyenangkan.Untuk mengantisipasi masalah yang terjadi dalam pemenuhan hakreproduksi pasangan rnenikah. pendidikan untuk menurnbuhkan kesadaran tentanghak reproduksi sangat diperlukan. Suami dan istri rnerniliki peran dan tanggungjawab yang sama dalam rurnah tangga, sehingga tidak bisa diserahkan hanyakepada satu pihak untuk menyelesaikan masaiah keluarga. Mereka harusmenyadari dan mempersiapkan diri untuk menghadapi rnasalah pemenuhan hakreproduksi sejak dini. Hak reproduksi penting bagi setiap individu demlterwujudnya kesehatan individu secara utuh, baik kesehatan jasmani maupunrohani sesuai dengan norma-norma hidup sehat.

AbstractReproductive right is an important part of holistic human right. Betweenspouses1 reproductive right have to be fulfilled in at least five based condition,these are <:consent, equality, respect, trust, and safety.This study was conducted io get description about reproductive rightfulfilling among moslem women in different ages of marriage. The study designused in this research is qualitative by using in depth interview methods of datacollection. This case study carried out with 6 (six) ·women as infonautsinterviewed, and also their families or neighbors. The study was started inNovember 2007 until December 2008.By using the Theory of Reasoned Action, it <;could be explained that noneof the informants are really fulfilled their reproductive right Attitude as internalfactor and subjective norm that influenced by other people's perception asexternal factor was considered to their intention. Not all of other people's beliefaccepted by informant, they selected specific people to obey. lnformans in earlyage of marriage relatively had less problems in reproductive right fulfilling thanthose are in middle and advance age of marriage.Researcher also found that status, position. and decision of men alwaysdominate all kind of reproductive right fulfilling. While friends and health officerscould have more chance to change her subjective none if only she had good effortto find out any information and gain reproductive health condition herself activelyand critically. For avoiding having next baby in recent time, women usecontraceptive methods, Their husband tried condom, but soon they did not feelcomfortable, The wives keep using contraceptive methods (pills, IUDs, orimplants) eventually they could have unpleasant side effect.Premarital and marital counseling are really needed to anticipatereproductive right fulfilling problems between spouse. Husbands and wives havetheir own role and responsibility, not only one himself/herself to solve the familyproblem. "This review article gives a brief history of the classical experiments that led to the development of the embryo culture medium and in vitro embryo culture. It proposes that, in view of the outstanding and significant pioneering contributions of Wesley Kingston Whitten to the development of embryo culture medium, he be considered the “Father of Embryo Culture Medium”. Furthermore, it describes the nutritional requirements of early embryos and how these requirements with specific references to carbohydrates, amino acids, phosphates, growth factors, etc, have been utilized to formulate increasingly more complex embryo culture media. This has led to the development of progressively more efficacious embryo culture media including the formulation of completely defined and synthetic protein-free embryo culture medium. The review also describes physical factors, growth factors, insemination methods for the fertilization of oocytes and culture methods affecting embryo growth, development, metabolism, oxygen embryotoxicity and survival. In procedural terms, the review also summarizes the evolution of embryo culture techniques from tube culture to, microdrop culture under oil to co-culture to ultra microdrop culture techniques. It includes techniques of in vitro maturation and for the selection of potentially viable embryos of various developmental stages"
