"ABSTRAK
Inovasi telah lama diakui sebagai sumber penting bagi pencapaian
keunggulan daya saing. Namun dalam industri asuransi terdapat perbedaan
pandangan terhadap konsep ini; beberapa pelaku industri telah menyadari
pentingnya inovasi sebagai sumber untuk mencapai pertumbuhan dan daya saing,
sementara sebagian lagi lebih memilih imitasi sebagai sumber untuk mencapai
keunggulan biaya rendah. Dalam upaya meneliti isu inovasi dalam industri
asuransi, studi ini memperluas studi Liao, Fei, dan Chen (2007) tentang hubungan
antara knowledge sharing dan kapasitas absorptif dan pengaruh positifnya
terhadap kapabilitas inovasi, dengan memasukkan faktor-faktor penghambat
inovasi ke dalam kerangka studinya; dan meneliti pengaruh positif kapabilitas
inovasi terhadap kinerja perusahaan (e.g.: Garcia-Morales, Llorens-Montes, &
Verdu-Jover, 2008).
Melalui analisis atas data riset dari 212 strategic business unit dari 64
perusahaan asuransi yang beroperasi di Indonesia, studi ini menemukan bahwa
faktor hambatan-inovasi berpengaruh negatif pada kapabilitas inovasi namun
hubungan sinergis antara knowledge sharing dan kapasitas absorptif dapat
mengeliminasi atau meminimalisasi pengaruh negatif tersebut. Studi ini juga
menemukan bahwa faktor-faktor hambatan-inovasi memiliki akarnya di luar
perusahaan namun harus ditangani dengan menggunakan sumber daya
pengetahuan internal. Temuan ini menimbulkan pertanyaan mengenai kebutuhan
untuk mengkaji ulang konsep manajemen pengetahuan dan knowledge sharing
agar tidak berfokus hanya pada pengetahuan internal tetapi perlu diperluas dengan
pengetahuan eksternal.
Studi ini menyarankan kepada pelaku industri asuransi di Indonesia untuk
segera meninggalkan strategi ?blind imitation? dan meningkatkan basis
pengetahuan melalui manajemen pengetahuan yang terintegrasi antara
pengetahuan internal dan pengetahuan eksternal; dan kepada regulator asuransi
agar memberikan arahan yang lebih tegas mengenai penggunaan dana pendidikan
dan latihan perusahaan asuransi pada pengetahuan state-of-the-art untuk tujuan
inovasi dalam upaya meningkatkan keunggulan daya saing perusahaanperusahaan
asuransi Indonesia di dalam negeri maupun di pasar regional atau
internasional;

ABSTRACT
Innovation has long been considered important source of competitive
advantage. However, in insurance industry innovation receives conflicting views
from the players; either as a critical source of growth and competitiveness, or
costly undertaking as opposed to low cost imitation. In investigating this issue,
this research extends the study of Liao, Fei, and Chen (2007) on the relationship
between knowledge sharing and absorptive capacity and its effect on innovation
capability, by incorporating innovation barriers into the framework; and the
influence of innovation capability on firm performance (e.g.: Garcia-Morales,
Llorens-Montes, & Verdu-Jover, 2008).
Research in this study, conducted on 212 strategic business units of 64
insurance companies in Indonesia, found that innovation barriers had negative
impact on innovation capability but the synergic relationship between knowledge
sharing and absorptive capacity could reduce such a negative influence. This
study also found that innovation barriers have their roots outside organization but
have to be dealt with by developing and enforcing internal knowledge sharing of
resources. The findings prompt a question of rethinking knowledge management
to not only focus on internal knowledge sharing but to include external knowledge
sharing in an integrated system.
This study recommends the Indonesian insurance industry to immediately
leave the 'blind imitation' strategy and enhance their knowledge base through an
integrated knowledge management between internal knowledge and external
knowledge; and the insurance regulators to provide more explicit direction
regarding the use of funds for insurance company?s education and training on
state-of-the-art knowledge for innovation purpose, in order to increase
competitive advantage of Indonesian insurance companies in domestic market as

"ABSTRAK
Prinsip indemnitas dan subrogasi merupakan prinsip utama dalam asuransi,
terutama asuransi kerugian, yang harus dipegang teguh agar asuransi dapat
berjalan sesuai dengan tujuannya, yaitu ganti rugi. Salah satu jenis asuransi
kerugian yang berkembang pesat seiring meningkatnya jumlah kendaraan
bermotor dan risiko atasnya adalah asuransi kendaraan bermotor. Sebagian besar
kendaraan bermotor ternyata tidak dibeli secara tunai tetapi dengan menggunakan
fasilitas pembiayaan, seperti perjanjian pembiayaan konsumen (PPK), yang tidak
dapat dipisahkan dari perjanjian asuransi kendaraan bermotor. Skripsi ini akan
membahas pengaturan prinsip indemnitas dan subrogasi di Indonesia, (termasuk
perbandingannya dengan beberapa negara lain), serta penerapannya dalam
putusan Pengadilan Negeri No. 176/Pdt.G/2011/Jkt.Ut yaitu putusan atas gugatan
ganti rugi kepada pihak ketiga atas sebuah mobil, yang masih berada dalam masa
PPK dan pertanggungan. Penelitian ini merupakan penelitian yuridis-normatif,
dimana penulis menggunakan tiga pendekatan yaitu undang-undang, konseptual
dan studi kasus. Selain itu, penulis menggunakan metode analisis kualitatif.
Setelah melakukan perbandingan dan analisis, ternyata pengaturan prinsip
indemnitas dan subrogasi masih belum baik dan Majelis Hakim pada kasus
tersebut, belum memahami dan menerapkan kedua prinsip tersebut. Agar dapat
dilaksanakan dengan baik, maka pengaturan kedua prinsip tersebut harus
diperbaharui, diatur lebih lanjut atau diperjanjikan secara jelas dalam polis, serta
pengetahuan hakim dalam bidang hukum asuransi harus terus ditingkatkan.

ABSTRACT
Indemnity and Subrogation Principles are two main principles in insurance
law that have to be implemented so the purpose of insurance, indemnification, can
be achieved. These principles are also applied in Automobile Insurance. In
Indonesia, a lot of people bought their vehicles using a Counsumer Financing
Agreement, which cannot be separated from Insurance Agreement. In this

The decision itself is related to Insurance Agreement and Consumer Financing
Agreement. This research is a normative and qualitative research. After analyzing
the problem in this research, I came to the conclusion that the regulation about
indemnity and subrogation principles is still not good enough, and the judges still
􀁋􀁄􀁇􀁑􀂶􀁗􀀃􀁘􀁑􀁇􀁈􀁕􀁖tood and didn􀂶t implement those two principles in their decision. In
my opinion, the government should make a new and a better regulation and the
insurer and the insured have to make detailed regulations on insurance policy
regarding indemnity and subrogation principles and lastly, the judges have to
improve their knowledge in Insurance Law, so the two principles can be well
implemented in court."

Penelitian ini membahas mengenai faktor-faktor yang memengaruhi penerapan manajemen risiko reputasi dan pengaruh dari penerapan manajemen risiko reputasi terhadap nilai perusahaan (Tobins Q) pada perusahaan perbankan dan asuransi yang terdaftar di Bursa Efek Indonesia tahun 2008-2017. Sampel yang digunakan mencakup 360 hasil observasi firm-year yang terdiri dari 36 perusahaan selama 10 tahun. Pengujian hipotesis dalam menentukan determinan penerapan manajemen risiko reputasi dilakukan melalui regresi panel logistik dan pengujian hipotesis pengaruh penerapan manajemen risiko reputasi terhadap nilai perusahaan dilakukan menggunakan metode regresi data panel fixed-effects. Analisis univariat juga dilakukan untuk melihat perbedaan antara hasil observasi perusahaan yang menerapkan RRM dan tidak menerapkan RRM. Hasil penelitian menunjukan semakin besar ukuran (firm size), tingkat hutang (leverage) dan kesadaran akan reputasi (reputation awareness) maka semakin besar probabilitas perusahaan untuk menerapkan RRM dan hasil ini signifikan secara statistik. Selain itu, terdapat pula tanda awal bahwa RRM memengaruhi nilai perusahaan dilihat dari analisis univariat dimana perusahaan yang menerapkan RRM memiliki rata-rata nilai Tobins Q yang lebih tinggi dari perusahaan yang tidak menerapkan RRM dan signifikan secara statistik meskipun dari hasil regresi hubungan antara RRM yang positif memengaruhi nilai perusahaan tidak signifikan secara statistik.


This study discussed the factors that affect the implementation of Reputation Risk Management (RRM) and the effect of the implementation of Reputation Risk Management (RRM) on the firm value (Tobins Q) in banking and insurance firms listed on the IDX in 2008-2017. The sample used includes 360 firm-year observations consisting of 36 companies over 10 years. The hypothesis testing regarding the determinants RRM is done through panel logistic regression and hypothesis testing on the effect of RRM implementation on firm value is carried out using the fixed-effects panel data regression method. Univariate analysis was also conducted to see the differences between the results of observations of companies implementing RRM and not. The results shows that the greater the firm size, leverage and reputation awareness of the firm, the greater the probability of the company to implement RRM and this result is statistically significant. In addition, there is an initial indication of the value-relevance of RRM seen from univariate analysis that shows firms applying RRM have a higher firm value on average than companies that do not implement RRM and are statistically significant eventhough the regression results between RRM relationships are positive influencing firm value has not been statistically significant.
