"Dugaan Bank Indonesia atas adanya tindak pidana perbankan yaitu kredit fiktif yang dilakukan oleh SW sebagai pemegang saham pengendali PT. BPR. TS menyebabkan PT. BPR TS dicabut ijin usahanya. Pencabutan ijin usaha oleh Bank Indonesia mengakibatkan beralihnya kewenangan pengurus dan pemegang saham beralih kepada Lembaga Penjamin Simpanan (LPS). Untuk itu, LPS akan melakukan tindakan pengembalian dana nasabah serta melikuidasi bank. Permasalahan yang dibahas dalam tesis ini adalah mengenai pengembalian dana nasabah PT. BPR TS yang dilakukan oleh LPS serta akibat hukum bagi direksi, dewan komisaris dan pemegang saham PT. BPR TS (dalam likuidasi). Penelitian ini merupakan penelitian normatif dengan sifat penelitian eksplanatoris. Data yang digunakan penulis dalam penelitian ini adalah data sekunder. Kesimpulan dari penelitian ini adalah bahwa tidak semua simpanan nasabah PT. BPR TS (dalam likuidasi) dikembalikan oleh LPS, serta baik pengurus maupun pemegang saham bertanggung jawab terhadap dilikuidasinya PT. BPR TS (dalam likuidasi).

Bank of Indonesia suspicions, that there is a fraud done by SW as a dominator’s shareholders at PT. BPR- TS causes Bank of Indonesia revoke license of PT. BPR. TS. The result of this revocation is Indonesia Deposit Insurance Corporation (IDIC) take over all duty and authority of board of director, board of commissioner and share holders. Because of that, IDIC must retum deposit and liquidation PT. BPR TS (m liquidation). This thesis is discussing about how the IDIC will retum deposit at PT. BPR TS (in liquidation) and also legal action consequences for PT. BPR TS (in liquidation)’s board of director, board of commissioners and shareholders. The typc of this research is explanation nonnative research. The data will be collected from literature and interview. The conclusion of this research are IDIC did not retum all the customers deposit at PT. BPR TS (in liquidation), and all PT. BPR TS (in liquidation)’s board of director, board of commissioner, and shareholders have responsibility because of liquidation."

"Likuidasi bank adalah suatu proses bagi bank yang di cabut izin usahanya untuk menyelesaikan segala kewajiban kepada krediturnya. Pasca berlakunya UU no 24 tahun 2004 tentang LPS, kewenangan likuidasi yang dahulu berada di Bank Indonesia (BI) berpindah ke Lembaga Penjamin Simpanan (LPS). Dimana dalam hal ini LPS akan membentuk Tim Likuidasi dalam pelaksanaan likuidasi di lapangan. Dan bagi nasabah yang banknya di tutup, simpananya akan di bayarkan oleh LPS selama memenuhi persyaratan yang di tentukan. Salah satu hal yang menyebabkan simpanan nasabah tidak di bayarkan oleh LPS adalah di himpunnya simpanan tersebut pada masa bank dalam pengawasan khusus BI.
Dalam skripsi ini akan di uraikan bagaimana kedudukan dan tanggung jawab LPS bagi nasabah bank yang dilikuidasi. Di mana LPS sesungguhnya masih memiliki tanggung jawab moral terhadap nasabah walaupun simpananya termasuk simpanan yang tidak di jamin. Pembahasan mengenai hal ini di lakukan dengan studi kasus pada salah satu bank yang di likuidasi yakni PD BPR Bungbulang Garut (DL).

Bank liquidation is a process for the bank whose license has been revoked to finish all of the liabilities to the creditor. After the law number 24 year 2004 concerning Deposit Insurance Corporation, the authority to liquidation is remove from Bank of Indonesia (BI) to Indonesia Deposit Insurance Corporation (IDIC). And to do this, IDIC appoint a liquidation team to make bank liquidation on the field. And for the depositors who bank is closed, the deposits will pay by IDIC as soon as fullfil the requirement. One of the reason make deposits will be not eligible for payment becauses the deposits is take when bank in special survailance unit.
In this research will be describe how the position and the responsible of IDIC to depositors who bank has been liqiuidation. Whereas actually IDIC still have moral responsible to the depositors even the deposits is not eligible to pay. This research will describe with case study in on of the liquidation bank, it is PD BPR Bungbulang (DL).

"Fokus tesis ini membahas eksistensi Aset Eks Bank Dalam Likuidasi (Aset Eks BDL) yang permasalahannya timbul akibat dilakukannya penghapusan Aset Eks BDL dari Neraca Sementara Likuidasi (NSL) oleh Tim Likuidasi. Tesis ini menggunakan desain penelitian yuridis normatif yang disajikan secara kualitatif dengan teknis analisis deskriptif dan kritis. Berdasarkan Peraturan Lembaga Penjamin Simpanan tentang Likuidasi Bank (PLPS LB) diatur ketentuan bahwa Lembaga Penjamin Simpanan (LPS) berwenang mengelola Aset Eks BDL, namun permasalahannya adalah tidak ditemukannya alas hak bagi LPS untuk melakukan pengelolaan tersebut. Sebelum status badan hukum BDL hapus, tidak dilakukan terlebih dahulu penyerahan (levering) atau pengalihan piutang (cessie) dari Tim Likuidasi kepada LPS sehingga, secara yuridis tindakan penghapusan Aset Eks BDL dari NSL tidak benar-benar menghapuskan kepemilikan aset oleh BDL. Oleh karena itu, untuk menghindari potensi permasalahan hukum kedepannya, ada baiknya LPS memberi pengaturan yang jelas mengenai alas hak bagi LPS dalam melakukan pengelolaan Aset Eks BDL dengan tetap memperhatikan pelaksanaan likuidasi 16 bank yang dicabut izinnya pada tahun 1997, dimana Negara (c.q. Kementerian Keuangan) sebagai kreditur mayoritas menerima sisa Aset Eks BDL sebagai pembayaran non-tunai.

The focus of this thesis is the existence of Ex Liquidated Bank Assets (Ex BDL Assets) whereby the issue at hand arises from the removal of Ex BDL Assets from the Liquidation Team?s (Liquidator) Balance Sheet of Liquidation (NSL) by the Liquidators. This thesis uses normative legal research methods which is presented in qualitative approach and the technical analysis is descriptive and critical. Pursuant to the Indonesia Deposit Insurance Corporation (IDIC) Regulation on Bank Liquidation (PLPS LB), IDIC has the authority to manage the Ex BDL Assets, however the issue at hand is that IDIC does not have the legal right to manage the Ex BDL Assets. Prior to the cessation of BDL?s legal status, since a delivery (levering) or transfer of receivables (cessie) has never been carried out by the Liquidator, the removal of such Ex BDL Assets from the NSL does not factually eliminate the ownership of BDL. Due to such issue, to avoid potential legal issue in the future, IDIC needs to make a clear regulation on the legal rights of IDIC to manage Ex BDL Assets by referring to the implementation of liquidation upon 16 banks whose licenses were revoked back in 1997, whereby the Government of Indonesia as (c.q. the Ministry of Finance) as majority creditor has accepted Ex BDL Assets as non-cash payment."

"Tesis ini membahas kemampuan mahasiswa Fakultas Hukum Universitas Indonesia angkatan 2007 dalam mencari dan menggunakan informasi secara efektif dalam konteks active learning dan self regulated learning selama mereka mengikuti Program Dasar Pendidikan Tinggi. Penelitian ini adalah penelitian kualitatif dengan desain deskriptif. Hasil penelitian menyarankan agar dalam pembubaran badan hukum bank berbentuk perusahaan daerah didukung adanya Peraturan Daerah dari daerah yang mendirikan, dan koordinasi yang baik dengan Kementerian Dalam Negeri.
LPS merupakan suatu badan hukum yang didirikan berdasarkan UU No. 24 tahun 2004 tentang LPS. Dalam menjalankan tugas dan fungsinya, LPS menjamin simpanan nasabah penyimpan pada bank dan turut aktif dalam memelihara stabilitas sistem perbankan dan sistem keuangan bersama-sama dengan Menteri Keuangan dan Gubernur Bank Indonesia. Dalam konteks menjaga stabilitas sistem perbankan, LPS melaksanakan penyelesaian dan penanganan bank gagal yang diserahkan penanganannya oleh LPP/BI.
Agar pelaksanaan pembubaran dan likuidasi oleh LPS dapat berjalan dengan baik, dibutuhkan hal-hal sebagai berikut: 1. adanya kewenangan publik yang dimiliki oleh LPS yang dapat mengesampingkan ketentuan lain yang mengatur tentang pembubaran dan likuidasi bank; 2. dukungan dan perananan pemerintah daerah dalam membantu kelancaran pelaksanaan pembubaran dan likuidasi bank berbentuk perusahaan daerah melalui penerbitan Peraturan Daerah.

The focus of this study is the freshman student of Faculty of Law at University of Indonesia experience of acquiring, evaluating and using information, when they enroll in 'Program Dasar Pendidikan Tinggi' 2007. This research is qualitative descriptive interpretive. The conclution of this research suggest to make The Regional Government's Regulation (Perda) by the regional government who established the regional rural bank to support Indonesia Deposit Insurance Corporation's decision in dissoluting and liquidating the regional rural bank on the bases of Law concerning Indonesia Deposit Insurance Corporation (IDIC).
IDIC is a legal entity that was established on the basis of Law No. 24 of 2004 concerning IDIC. In accordance with its role and responsibilities, IDIC insures depositors funds in the banks and actively maintains the stability of the banking and financial systems in close coordination with the Minister of Finance, Bank Indonesia, and the LPP (Financial Supervisory Authority). Within the context of the maintaining the stability of the banking system, IDIC resolves and handles failed banks that are turned over by LPP/BI.
The following aspects are required to ensure that the closure and liquidation process are effectively carried out by IDIC: 1) IDIC is duly authorized by the public, whereby it will be able to override other provisions governing bank closures and liquidation; 2) Support and role of the regional government to ensure the effectiveness of the closure and liquidation of regional/provincial-owned banks through the issuance of a Regional/Provincial Regulation.

Sebagai salah satu unsur penting dalam jaring pengaman sistem keuangan khususnya dibidang perbankan, Lembaga Penjamin Simpanan (LPS) memiliki peranan untuk menjaga stabilitas keuangan Indonesia. Krisis ekonomi global pada tahun 2008 mengharuskan LPS meningkatkan Nilai Penjamin Simpanan. Penelitian ini bertujuan untuk mengetahui alasan LPS meningkatkan Nilai Penjamin Simpanan berdasarkan Undang-Undang Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang No. 7 Tahun 2009 dan peraturan perundang-undangan yang berlaku, menganalisis kemungkinan penurunan Nilai Penjamin Simpanan LPS serta hubungannya dengan penerapan risk-based premium di Indonesia untuk menjaga stabilitas sistem keuangan Indonesia. Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis-normatif. Data yang dikumpulkan dengan studi kepustakaan. Hasil dari penelitian ini adalah berdasarkan Pasal 11 UU LPS dimungkinkan terjadi penurunan terhadap Nilai Penjamin Simpanan LPS. Berdasarkan alasan peningkatan Nilai Penjamin Simpanan pada tahun 2008, yaitu adanya ancaman krisis ekonomi, UU LPS mengatur apabila alasan tersebut telah teratasi maka besaran Nilai Penjamin Simpanan dapat disesuaikan kembali. Maka berdasarkan hal ini, dimungkinkan untuk menurunkan Nilai Penjamin Simpanan LPS.

As one of the important elements in the financial safety net, especially in banking system, Indonesia Deposit Insurance Corporation (IDIC) has a big role to keep the stability of Indonesia?s financial system. The global economic crisis in 2008 requires IDIC increase the Deposit Insurance Coverage. This studies aims to determine the reaseon IDIC increase the coverage based on Law No. 24 of 2004 on the Indonesia Deposit Insurance Corporation (IDIC) as amended by Act No. 7 of 2009, to analyze the possibility to decrease the deposit insurance coverage and its relation to the risk-based premium in Indonesia in order to maintan the stability of the financial system. This research is a normative juridical research. The data were collected by literature study. The results for this study are based Article 11 of IDIC Act, there is a posibility to adjust the Deposit Insurance Coverage. IDIC increased the coverage in 2008 because there is a threat of an economic crisis. So based on this Act, if the threat is no longer a problem for Indonesia, IDIC can adjust to decrease the Deposit Insurance Coverage.

"Skripsi ini berisi tentang tinjauan hukum dari program pengembalian dana (cash back) yang dihitung sebagai komponen bunga dalam menentukan criteria simpanan layak bayar oleh LPS. Penelitian ini menggunakan metode kualitatif, yang menghasilkan data deskriptif analitis yang memberikan deskripsi mengenai pengaturan cash back oleh Lembaga Penjamin Simpanan dengan melakukan studi kasus terhadap pembayaran klaim nasabah dalam likuidasi Bang IFI.
Hasil penelitian menyatakan bahwa sebelum diberlakukannya PLPS No. 2/PLPS/2010 tentang Program Penjaminan Simpanan, terjadi kesimpangsiuran hokum dalam pengaturan cash back yang akibatnya berdampak dalam pembayaran klaim nasabah Bank IFI. Selain itu, pengaturan tegas mengenai cash back dalam PLPS tersebut masih membuka kemungkinan kasus seperti Bank IFI kembali terjadi maka penulis menyarankan agar terdapat larangan terhadap pengadaan program cash back oleh Bank.

The Essay is about The Legal Review of Cash Back Program which is counted as interest's component in determining Criteria of Eligible Deposit by Indonesian Deposit Insurance Corporation (IDIC). This research uses qualitative method which produces descriptive analytical data concerning description about cash back regulation by Deposit Insurance Corporation which will be related to the case of IFI Bank Liquidation.
The result stated that before IDIC Regulation Number 2/PLPS/2010 about Deposit Insurance Program was valid; there was an ambiguous of cash back regulation which leads to the case of The Refund of Costumer Claim in IFI Bank. Moreover, the explicitness of that cash back regulation, in the newest IDIC Regulation, still opens a possibility for case like IFI Bank to reoccur. Therefore, the researcher suggests that cash back program by Bank should not be allowed.

"Lembaga Penjamin Simpanan (LPS) telah melakukan berbagai langkah untuk membangun kesiapan penyelenggaraan Program Restrukturisasi Perbankan, diantaranya menyiapkan peraturan pelaksana dan kebijakan terkait proses bisnis. Namun demikian, terdapat permasalahan yang belum dapat diputuskan oleh LPS terkait dengan penyajian pelaporan keuangan Program Restrukturisasi Perbankan. Penelitian ini bertujuan untuk menyusun analisis yang dapat dijadikan dasar pertimbangan dalam menentukan penyajian pelaporan keuangan Program Restrukturisasi Perbankan. Analisis mencakup hal tentang pengguna pelaporan keuangan, asesmen keunikan transaksi keuangan, entitas pelaporan, dan standar akuntansi keuangan yang dapat digunakan untuk melakukan penyusunan pelaporan keuangan. Metode yang digunakan dalam penelitian ini menggunakan metode studi kasus tunggal, dengan penggunaan teknik penyusunan eksplanasi untuk menganalisis data. Hasil analisis menunjukkan bahwa Program Restrukturisasi Perbankan memiliki pengguna laporan keuangan yang bersifat pervasif, tidak memiliki transaksi unik yang belum terdapat dasar pengaturannya dalam Standar Keuangan Akuntansi umum, dan merupakan entitas pelapor yang terpisah dari LPS yang dapat menggunakan asumsi kelangsungan usaha. Dengan demikian, Program Restrukturisasi Perbankan dapat menyajikan pelaporan keuangan tujuan umum dengan menggunakan standar akuntansi yang berlaku umum.

The Indonesia Deposit Insurance Corporation (IDIC) has taken various steps to build readiness for the implementation of the Banking Restructuring Program, such as preparing regulations and policies related to business processes. However, there is a problem that has not been decided by IDIC related to the presentation of the financial reporting of the Banking Restructuring Program. This study aims to compile an analysis that can be used as a basis for consideration in presenting the financial statements of the Banking Restructuring Program. The analysis includes matters concerning users of financial reporting, assessment of the uniqueness of financial transactions, reporting entities, and accounting standards that can be used to prepare financial reporting. The method used in this research uses a single case study method, with the use of explanation-building techniques to analyze the data. The results of the analysis show that the Banking Restructuring Program has pervasive users of financial statements, does not have unique transactions that have not been regulated in general accounting standards, and is a separate reporting entity from the Indonesia Deposit Insurance Corporation that can use the going concern assumption. Thus, the Banking Restructuring Program can present general purpose financial reporting using generally accepted accounting standards."

"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.

This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."

"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.

This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."
