"Kematian merupakan risiko yang ditanggung dalam asuransi jiwa dan perusahaan asuransi wajib membayar dana asuransi kepada ahli waris yang ditunjuk sebagai penerima manfaat jika terjadi kematian. Namun, permasalahan muncul ketika ada ahli waris menurut hukum perdata merasa berhak memiliki dana asuransi padahal dirinya bukan penerima manfaat. Penelitian ini berbentuk yuridis normatif dengan studi kasus putusan dan bertujuan untuk mengkaji kedudukan penerima manfaat. Adapun permasalahan yang dibahas, yaitu bagaimana pengaturan ahli waris menurut hukum perdata, bagaimana kedudukan penerima manfaat secara hukum kewarisan, dan perlindungan hukum terhadap ahli waris dan penerima manfaat apabila terjadi pembagian harta warisan. Berdasarkan hasil analisis, dana asuransi hanya berhak dimiliki oleh ahli waris yang ditunjuk menjadi penerima manfaat dan mempunyai insurable interest dengan tertanggung. Tidak semua ahli waris menurut hukum perdata merupakan penerima manfaat. Oleh karena itu, dana asuransi bukan bagian dari harta warisan. Dengan demikian, jika tertanggung meninggal dan terjadi pembagian harta warisan, ahli waris menurut hukum perdata hanya berhak atas harta kekayaan tertanggung yang diatur sesuai dengan ketentuan hukum waris yang berlaku.

The death of an individual is a risk covered by a life insurance agreement. In the event of this risk occurring, the insurance company is obligated to pay a certain amount of compensation or insurance proceeds to the designated heirs who are beneficiaries of the insurance. However, complications arise when legal heirs feel entitled to insurance funds despite not being the designated beneficiaries. This study, employing a normative juridical approach and utilizing case studies, aims to examine the position of beneficiaries. The issues addressed include the legal status of heirs in civil law, the legal position of beneficiaries concerning inheritance, and legal protection for both heirs and beneficiaries during inheritance distribution. The analysis concludes that insurance funds rightfully belong only to heirs specifically designated as beneficiaries, possessing an insurable interest with the insured party. Not all legal heirs according to civil law qualify as beneficiaries. Consequently, insurance funds do not constitute part of the inheritance. Hence, in the event of the insured's demise and subsequent inheritance distribution, legal heirs under civil law are entitled solely to the insured's wealth regulated according to the applicable inheritance laws."
