"Dalam UU Kepailitan telah diatur badan-badan yang tidak serta merta dapat dimohonkan palilit seperti Bank-bank, perusahaan efek dan perusahaan asuransi, serta BUMN. Nam.un pembaruan hukum kepailitan dalam Undang-Undang Nomor 37 Tahun 2004, telah menimbulkan perdebatan, khususnya menyangkut kepailitan sebuah BUMN. Kasus pailitnya PT Dirgantara Indonesia (PT. Dl) yang merupakan sebu.ah BUMN adalah kasus baro yang terjadi di Indonesia . Hakim Pengadilan Niaga Jakarta Pusat pada tanggal 4 September 2007 telah memutuskan PT. DI pailit dengan segala risiko hukum. PT. DI dalam persidangan terbukti gagal tidak memenuhi kewajibannya membayar pesangon kepada mantan karyawannya, dan terhadap dua kreditor lainnya yakni Neli Ratna Sari dan Supriadi Jasa PT.DI tidak meneri.ma putusan pemyataan pailit tersebut. Kemudian mengajukan kasasi ke Mabkamah Agung. Mahkamah Agung pada tanggal22 Oktober 2007 telah menjatuhkan putusan yang isinya mengabulkan pennobonan kasasi yang diajukan pemohon kasasi. Mahkamah Agung juga membatalkan putusan Pengadilan Niaga pada pengadilan Negeri Jakarta Pusat. Adanya putusan pailit kepada PT. DI telah menimbulkan perdebatan di kalangan praktisi hukum dan masyarakat pada umumnya. Beberapa permasalahan yang timbul dalam praktek adalah, Pertama, Dalam hal tetjadinya permobonan kepailitan terhadap BUMN, tidak semua pihak dapat mengajukan permohonan kepailitan, mengingat adanya ciri kh.as dari BUMN yaitu adanya unsur kepemilikan Negara dan tujuan dari BlJMN Wltuk melayani kepentingan umum. Namun demikian tidak semua BUMN yang dimaksud dalam Pasal 2 ayat 5 l.ffi Kepailitan pennohonan pailitnya hanya dapat diajukan oleh Menteri Keuangan. K.arena dalam. penjelasan Pasal 2 ayat 5 tersebut telah mensyaratkan BUMN yang bergerak di bidang kepentingan pu6lik: haroslah memenuhi dua syaxat yaitu seluruh modalnya dimiJiki Negara dan tidak texbagi alas saham. Kedua, dalam hal terjadinya perbedaan putusan kepailitan terhadap PT. Dirgantara Indonesia (Persero) antara Pengadilan Niaga dengan putusan Mabkamah Agung, maka menurut Penulis, putusan Pengadilan Niaga-lah yang telah sesuai dengan peraturan perundang-undangan yang berlaku. Namun demikian, Untuk kesempumaan dalam pengaturan UU Kepailitan dan memberikan keadilan terhadap debitor, maka perlu dilakukan pengujian (insolvency test) apakah benar seorang debitor telah dalam keadaan tidak mampu membayar harus mendapat perhatian. Tesis ini menggunakan metode penelitian hukum normatif dengan ruang lingkup proses kepailitan BUMN dan analisa terhadap putusan hakim pengadilan niaga dan putusan majelis hakim pada Mahkamah Agung, dengan tipologi penelitian adalah yuridis normative dengan menggunakan analisa deskriptif yuridis analitis yang ditujukan untuk menganalisisr putusan-putusan pengadilan yang aktual atas peristiwa atau fakta, pertimbangan hukum dan amar putusan dikaitkan dengan penerapan asas-asas hukum yang terkait.

Indonesian Company Law has governed companies which can not be automatically filed bankcrupt such as banks, security companies, insurance companies and state owned companies. However, the amendment of bankruptcy law , Law Number 37, 2004, has caused intense discussion, especially related to bankrupcy of state owned company (BUMN). In Indonesia, the bankrupcy case ofPT Dirgantata Indonesia (PT DI) is a new case regarding bankcrupcy of state owned company. On September 2007, the judge of commercial court of Jakarta Pusat declared PT DI bankcrupt with its legal consequences. In the hearing sessio PT DI failed to prove that it has paid severance money, as its obligation, to its ex­ employees and two other creditoiS, namely, Neli Ratna Sari and Supriadi Jasa. PT DI refused such bankcrupcy decision and filed Cassation to Supreme Cowt On 22 October 2007, Supreme Court rendered decision which granted the petitioner in Cassatioa The Supreme Court annuled the decision of commercial court of Jakarta Pusat District Court The bankcrupcy decision of PT DI has caused intense discussion among legal practitioner and society in general. Based on the reseach, I conclude, First, in the event of a petition in bankrupcy of BUMN,only a certain party who can fife a petition bankrupcy because there are some special characteristics of BUMN" namely, Indonesian Government as a shareholder and the main objective of BUMN to service public interest. However, not all BUMN as referred to Article 2 (5) of Indonesian Bankcrupcy Law, the petition in bankrupcy can only be filed by Minister of Finance because the elucidation of Article 2 (5) requires BUMN engages in public interest has to fulfill two conditions, namely, all capital owned by the Government and the share is undivided.Second,in the event there is diferent dicision ofbanlaupcy on PT DI (Persero) between Commercial Court Decision and Supreme Court Decision."

"PT. Dirgantara Indonesia merupakan industri kedirgantaraan terbesar di Indonesia sekaligus Perusahaan dari Badan Usaha Milik Negara yang dikembangkan sejak zaman Orde Baru dan berganti nama menjadi PT.DI yang berkecimpung dalam industri penerbangan. Peneliti mencoba berfokus pada aspek dampak dari Covid-19 terhadap kinerja perusahaan PT. DI guna mencari tahu celah kelemahan serta dapat menjadi acuan peneliti dalam menganalisis terkait perumusan kebijakan yang dilakukan oleh jajaran direksi PT. DI dalam menghadapi pandemi Covid-19 terkait produksi. Penelitian ini menggunakan metode deskriptif kualitatif. Untuk pengumpulan data terdiri dari primer dan sekunder, data primer diperoleh dengan cara observasi, wawancara dan dokumentasi. Sedangkan data sekunder diperoleh melalui hasil kepustakaan. Penelitian ini bertujuan untuk mengetahui dampak yang terjadi pada produksi selama pandemi Covid-19. pesawat pada PT. DI dan terkait kebijakan apa yang diambil oleh PT. DI dalam mengurangi dampak dari COVID-19 terhadap kinerja perusahaan. Berdasarkan hasil yang telah diperoleh dari penelitian ini menunjukakan bahwa dampak pandemi bagi produksi di PT. DI mengalami penghambatan di sektor produksi dan distribusi, maupun pemasaran yang tidak berjalan akibat pandemi Covid-19, dan juga terjadi penurunan penjualan sehingga mengurangi pendapatan, dan kurang permodalan.

PT. Dirgantara Indonesia is the largest aerospace industry in Indonesia as well as a company from a State-Owned Enterprise which was developed since the New Order era and changed its name to PT.DI which is involved in the aviation industry. Researchers try to focus on aspects of the impact of Covid-19 on the performance of the PT. DI company in order to find out the weaknesses and can be used as a reference for researchers in analyzing the policy formulation carried out by the PT. DI board of directors in dealing with the Covid-19 pandemic related to production. This study used descriptive qualitative method. For data collection consists of primary and secondary, primary data obtained by means of observation, interviews and documentation. While secondary data obtained through the results of the literature. This study aims to determine the impact that occurs on production during the Covid-19 pandemic. aircraft at PT. DI and related to what policies were taken by PT. DI in reducing the impact of COVID-19 on company performance. Based on the results obtained from this study, it shows that the impact of the pandemic on production at PT. DI experienced bottlenecks in the production and distribution sectors, as well as marketing that did not work due to the Covid-19 pandemic, and there was also a decline in sales resulting in reduced income and lack of capital."

Regarding to the TOWS Matrix of PT. Prima Value Indonesia, the company for this time could reach new potential clients and also could increase and maintain their promotion, by implementing SO Strategies, using company's internal strengths to take advantage of external opportunities. Furthermore, the company at this time could focus on the subject of property and pharmacy in doing workshops services as application of managing "focus strategy" in order to get to know their segments intimately and pursues either cost leadership or differentiation within their target segment. Those suggestions are expected could be use by the company to pursue its marketing objectives in the target market and also to position themselves strongly in the chosen target markets."

"Tesis ini membahas mengenai status PT Dirgantara Indonesia (Persero) dan PT Istaka Karya (Persero) yang merupakan Badan Usaha Milik Negara dan proses kepailitan terhadap kedua perseroan tersebut berdasarkan Undang-Undang Nomor 19 Tahun 2003 tentang Badan Usaha Milik Negara dan Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Metode penelitian yang digunakan adalah pendekatan yuridis normatif, sedangkan metode analisis datanya adalah metode kualitatif.
Kesimpulan dari penelitian adalah PT Dirgantara Indonesia (Persero) dan PT Istaka Karya (Persero) merupakan badan usaha milik negara dan hakim dalam menangani proses kepailitan PT Dirgantara Indonesia (Persero) dan PT Istaka Karya (Persero) belum dapat dikatakan telah menerapkan prinsip-prinsip hukum yang benar.
Hasil peneltian menyarankan perlu dilakukan harmonisasi peraturan perundangundangan di bidang keuangan yang terkait dengan pengaturan BUMN dan Perlu adanya pengertian/makna yang sama mengenai apa yang dimaksud BUMN yang bergerak di bidang ?kepentingan publik?.

The following thesis is examining regarding the status of PT Dirgantara Indonesia (Persero) and PT Istaka Karya (Persero) which are the State Owned Enterprises and the process of their insolvency based on the Law Number 19 of 2003 regarding State Owned Enterprises and Law Number 37 of 2004 regarding the Insolvency and Postponement of Debt Settlement Obligation. The thesis used juridical norms approach as research implementation method and also assessment of several qualitative data.
The conclusion of this thesis is PT Dirgantara Indonesia (Persero) and PT Istaka Karya (Persero) are the state owned enterprises and the judges who ajudicated the process of insolvency of PT Dirgantara Indonesia (Persero) and PT Istaka Karya (Persero) can not be determined has already applied the prevailing laws and regulation.
The end result of this thesis suggests that there should be a harmonization in the law and regulations, especially in the financial sector which related to the State Owned Enterprises? regulation and it is necessary to have the same understanding regarding the meaning of ?public interest? in State Owned Enterprises."

Enterpriser melakukan pemasaran melalui media sosial Instagram dengan pendekatan yang lebih soft melalui sharing, membangun bonding dan personal branding dengan memperlihatkan komunitas positif, serta mempersuasi dengan menggali ketakutan positif. Pemasaran melalui media sosial Instagram mempermudah percepatan bisnis dan menjangkau member.

This study aims to understand the communication strategy used by business actors, particularly HDI enterprises, in building their marketing relationships during the COVID-19 pandemic era. Relationship Marketing and persuasive tactics have a role in disseminating information that can build closeness with members and motivate members in the network marketing business. Enterprisers does marketing through Social Media Instagram with a soft approach through sharing, bonding and and personal branding by showing a positive community, and persuading by exploring positive fears. Marketing through social media Instagram makes it easier to accelerate business and reach members.

"ABSTRAK
Tesis ini membahas mengenai peran atribut consumer durable goods untuk planetary mixer SM-201 dalam menyusun strategi bauran pemasaran. Penelitian ini menggunakan metode penelitian eksploratori (teknik in-depth-interview) dan metode penelitian deskriptif. Penelitian ini dilakukan kepada 100 responden melalui teknik probability sampling. Berdasarkan hasil in-depth interview didapatkan 12 atribut consumer durable goods planetary mixer yang dibagi menjadi 2 kategori yaitu atribut instrinsik (tahan lama, reliabilitas mixer, kemudahan penggunaan, performansi, kemudahan servis, fitur, desain) dan atribut ekstrinsik (harga, merek, negara asal pembuat, garansi dan brand image). 12 atribut ini akan diuji hubungannya dengan karakteristik demografi responden.
Penelitian ini menghasilkan 4 cluster pelanggan yaitu cluster 1 (warranty-lover), cluster 2 (durable-lover), cluster 3 (price economic-lover) dan cluster 4 (comfortlover). Strategi bauran pemasaran produk yang akan dilakukan yaitu menerapkan proses produk augmented dan memprioritaskan atribut yang diinginkan pelanggan berdasarkan cluster pelanggan. Strategi bauran pemasaran distribusi dilakukan dengan sistem distribusi hibrid dan terpusat di kantor Jakarta. Strategi bauran pemasaran promosi dilakukan dengan pameran bakery, demo bakery dan sales door-to-door. Strategi bauran pemasaran harga dilakukan dengan pemberian diskon khusus dan pembayaran mesin secara kredit.

ABSTRACT
This thesis discusses the role of consumer durable goods attributes for planetary mixer SM-201 in developing marketing mix strategy. This research uses exploratory research (technical in-depth-interviews) and descriptive research method. The research is conducted with 100 respondents through probability sampling technique. Based on the results of in-depth interviews found 12 attributes of consumer durable goods planetary mixers are divided into 2 categories: intrinsic attributes (durability, reliability mixer, ease of use, performance, serviceability, features, design) and extrinsic attributes (price, brand, county-of-origin, warranty and brand image). 12 attributes will be tested which are related to the demographic characteristics of respondents.
This research resulted in four clusters, namely cluster 1 (warranty-lover), cluster 2 (durablelover), cluster 3 (price economic-lover) and cluster 4 (comfort-lover). Marketing mix strategy will be applied the augmented product process and prioritize attributes desired based on customer clusters. Marketing mix strategy distribution will be applied with hybrid and centralized distribution system in the Jakarta office. Marketing mix promotion will be applied by the bakery exhibition, bakery demos and sales door-to-door. Price marketing mix will be applied by assigning a special discount and on credit-payment machines.

"Tesis ini membahas Kasus Kepailitan PT Dirgantara Indonesia yang berstatus sebagai BUMN berbentuk Persero berdasarkan ketentuan UU Kepailitan dan permasalahan terkait aset PT Dirgantara Indonesia, termasuk ke dalam aset Negara atau aset perusahaan tersebut serta diperlukannya tes kemampuan untuk membayar utang dan kesehatan keuangan (solvency test) dalam kasus Kepailitan PT Dirgantara Indonesia. Penelitian ini adalah penelitian kualitatif dengan desain perskriptif. Hasil penelitian menyarankan bahwa langkah terbaik yang dapat dilakukan adalah mengubah ketentuan dalam Penjelasan Pasal 2 ayat (5) UU Kepailitan dengan menghilangkan kata-kata “terbagi atas saham”; MA Sebagai Pengadilan Negara Tertinggi harus konsisten dengan putusannya, khususnya mengenai putusan MA dalam memandang status aset BUMN; UU Kepailitan harus segera direvisi dengan mencantumkan tes kemampuan untuk membayar utang dan kesehatan keuangan (solvency test) sebagai salah satu syarat mengajukan Kepailitan.

The focus of this study is discusses the Bankruptcy case of PT Dirgantara Indonesia, which are shaped as the state-owned company based on the Bankruptcy Law and problems related with assets of PT Dirgantara Indonesia, including assets of the State or assets of the company and the needs of test for the ability to pay debt and financial health (solvency test) in the Bankruptcy case of PT Dirgantara Indonesia. This research is qualitative research with perskriptif design. Research results suggest that the best step that can be done is to change the provisions of the Explanation of Article 2, paragraph (5) of Bankruptcy Law with erase the words “divided into shares”; Mahkamah Agung as a State Supreme Court must be consistent with the decision, especially about the decision of the Supreme Court considered the status of the state-owned company assets; Bankruptcy Law should be revised to include tests of test for the ability to pay debt and financial health (solvency test) as one of the requirements to Bankruptcy."
