"A paradigm change is occurring, in the course of which human beings are becoming the primary international legal persons. In numerous areas of public international law, substantive rights and obligations of individuals arguably flow directly from international law. The novel legal status of humans in international law is now captured with a concept borrowed from constitutional doctrine: international rights of the person, as opposed to international law protecting persons. Combining doctrinal analysis with current practice, this book is the most comprehensive contemporary analysis of the legal status of the individual. Beyond Human Rights, previously published in German and now revised by the author in this English edition, not only deals with the individual in international humanitarian law, international criminal law and international investment law, but it also covers fields such as consular law, environmental law, protection of individuals against acts of violence and natural disasters, refugee law and labour law."

"One of important mechanisms considered effective to protect civil and political rights of the
citizens in Indonesia is constitutional review. This mechanism was created after the constitutional
reform by establishing the new Constitutional Court in 2003 as an independent and separate
court from the Supreme Court. This article examines the development of human rights guaranteed
in the Indonesian Constitution. It also provides a critical analysis of the Constitutional Court?s
role in protecting civil and political rights in Indonesia through its landmark decisions on five
categories, namely: (1) freedom of assembly and association; (2) freedom of opinion, speech and
expression; (3) freedom of religion; (4) right to life; and (5) due process of law. This research
was conducted based on qualitative research methodology. It used a non-doctrinal approach by
researching the socio-political impacts of the Constitutional Court?s decisions. Although there are
still inconsistencies in its decisions, the research concludes that the Constitutional Court has taken
a step forward for a better protection of civil and political rights in Indonesia that never existed
prior to the reform.
reformasi."

Farrell, Brian R. (Brian Richard)
"Habeas Corpus in International Law is the first comprehensive examination of this subject. It looks at the location, scope, and significance of the right to a judicial determination of the legality of one's detention as guaranteed by international and regional human rights instruments. First, it examines the history of habeas corpus and its place in human rights treaties, providing a useful resource for understanding the status and application of this internationally-protected right. The book continues by identifying and analyzing the primary challenges to habeas corpus, in particular its applicability during armed conflict, the possibility of derogation, and its extraterritorial application and procedural shortcomings. The book next addresses the significance of habeas corpus guarantees not just in protecting personal liberty, but in promoting the international rule of law by serving as a unique check on executive action. Finally, it offers suggestions on how this right might be strengthened"
