Suatu akta autentik yang dibuat oleh Notaris yang terdapat surat kuasa seharusnya didahului penyerahan asli surat kuasa untuk menandatangani akta. Apabila Notaris dalam membuat akta autentik terdapat suatu surat kuasa yang palsu, maka akibat pada akta tersebut dapat dibatalkan. Permasalahan dalam tesis ini adalah akibat hukum dan tanggung jawab Notaris dengan adanya Akta Berita Acara Rapat Umum Pemegang Saham Perseroan Terbatas yang terdapat Surat Kuasa Palsu. Untuk menjawab permasalahan tersebut dilakukan penelitian dengan pendekatan yuridis normatif dengan cara meneliti bahan pustaka atau data sekunder belaka, tipologi penelitian ini merupakan penelitian preskriptif yaitu penelitian yang bertujuan untuk menganalisis peristiwa hukum konkret sesuai dengan teori. Hasil analisa adalah akibat dari akta berita acara rapat umum pemegang saham yang terdapat surat kuasa palsu ialah batal demi hukum karena tidak berwenangnya penghadap dalam akta serta bertentangan dengan undang-undang dan tanggung jawab notaris terhadap akta tersebut ialah dapat dikenakan sanski berupa sanksi administrasi, sanksi perdata maupun sanksi pidana. Seorang Notaris dalam membuat sebuat akta autentik harus cermat, teliti dan berhati-hati, terutama dalam memeriksa dan kewenangan dari para pihak yang menggunakan surat kuasa sebagai dasar kewenangannya, notaris harus memastikan penghadap yang menghadap berdasarkan kuasa memiliki bukti atas pemberian kuasa yang kuat.

An authentic deed made by a Notary that contains a power of attorney should be preceded by the original submission of the power of attorney to sign the deed. If the Notary makes an authentic deed there is a fake power of attorney, then the result of the deed can be canceled. The problem in this thesis is the legal consequences and responsibility of the Notary with the Deed of the Minutes of General Meeting of Shareholders of Limited Liability Companies which contains a fake power of attorney. To answer this problem, a normative juridical approach was carried out by examining library materials or secondary data. The typology of this research is prescriptive research, namely research that aims to analyze concrete legal events in accordance with theory. The results of the analysis are the result of the deed of the minutes of the general meeting of shareholders containing a forged power of attorney which is null and void because there are no witnesses in the deed and it is against the law and the responsibility of the notary for the deed is subject to sanctions in the form of administrative sanctions, civil sanctions or criminal sanctions. In making an authentic deed, a Notary must be careful, thorough and careful, especially in examining and the authority of the parties who use the power of attorney as the basis of their authority, the notary must ensure that the party that appears based on the power of attorney has evidence of a strong power of attorney.
