Dewasa ini, pesatnya perkembangan teknologi informasi dan komunikasi telah melahirkan berbagai macam mesin atau perangkat teknologi yang semakin canggih hingga kini telah mencapai suatu kemampuan otomatisasi yang dapat dilakukan oleh sistem komputer untuk melakukan berbagai macam pekerjaan manusia Salah satunya dalam proses identifikasi dan autentikasi pada sistem elektronik yang bertujuan untuk menunjukkan darimana suatu data atau informasi elektronik berasal terkait identitas subjek hukum dan kewenangannya. Dalam hal perdagangan melalui sistem elektronik, saat ini terdapat model bisnis terintegrasi yaitu online-to-offline (O2O) e-commerce atau disebut juga new retail yang menggunakan perangkat teknologi kecerdasan artifisial dalam proses transaksinya untuk otomatisasi agar pembeli dapat bertransaksi secara mandiri. Hasil analisis penelitian yuridis – normatif ini menunjukkan pengaturan hukum di Indonesia mengenai transaksi perdagangan melalui sistem elektronik (e-commerce) pada toko ritel tanpa kasir dengan model online to offline (O2O) secara spesifik dalam kasus ini yaitu JD.ID X yang menggunakan kontrak elektronik beserta sistem identifikasi dan autentikasi secara elektronik, belum adanya pengaturan mengenai penerapan teknologi kecerdasan artifisial, serta menjelaskan bahwa mekanisme transaksi dan kontrak berupa syarat dan ketentuan tersebut telah memenuhi keabsahan kontrak dari aspek kelayakan dan akuntabilitas sistem elektronik maupun aspek hukum perjanjian dan secara spesifik dalam konteks kontrak antara pelaku usaha dan konsumen yaitu terkait pencantuman klausula baku yang diatur dalam hukum perlindungan konsumen.

Nowadays, the rapid development of information and communication technology has given rise to various kinds of machines or technological devices that are increasingly sophisticated and have achieved automation capabilities that may be operated by computer systems to perform various kinds of human jobs. One of them is regarding the electronic system's identification and authentication process which aims to show and confirm how an electronic data or information comes from the identity of a legal subject and its authority. In terms of e – commerce nowadays, there is an integrated business model namely online-to-offline (O2O) e-commerce (also known as new retail), which uses artificial intelligence technology devices for automation during the transaction process with the purpose of making the buyers able to transact independently. The result of this juridical-normative research analysis explains about laws and regulations in Indonesia regarding trading through electronic systems (e-commerce) at an online-to-offline (O2O) cashierless retail store specifically in this case JD.ID X which uses electronic contract and electronic identification and authentication systems, the application of artificial intelligence technology, and explains how the transaction mechanism and contract in a form of terms & conditions has fulfilled the validity of electronic contracts from the aspect of feasibility and accountability of the electronic system along with the legal aspect of the agreement and specifically in the context of the contract between business actor and consumer related to the inclusion of standard clause stipulated in the consumer protection law.
