Protokol ialah kumpulan arsip negara yang harus disimpan dan diterima oleh Notaris. Setiap Notaris mempunyai kewajiban dan kesediaan untuk menerima protokol dari Notaris lain. Pertanggungjawaban Notaris terhadap setiap akta yang dibuatnya diatur dalam Pasal 65 Undang-Undang Jabatan Notaris yakni pertanggungjawaban tersebut dapat di tafsirkan adalah seumur hidup notaris. Dari setiap akta-akta yang dibuat oleh notaris tersebut apabila menimbulkan kerugian bagi pihak ketiga maka para pihak tersebut dapat melakukan penuntutan ataupun gugatan melalui Pengadilan, termasuk Notaris pemegang protokol sebagaimana ternyata dalam Putusan Nomor 22/Pdt/2012/PT.JBI tanggal 15 Agustus 2012, dimana terdapat 2 (dua) Notaris sebagai pemegang protokol Notaris yang telah meninggal dunia yakni Rober Faisal, S.H (selaku pemegang protokol dari Notaris/PPAT Hasiholan Situmeang, S.H) dan Juliani Martha, S.H, Mkn. (selaku pemegang protokol dari Notaris/PPAT Nani Widiawati, S.H) ikut dipanggil dalam pengadilan, diputuskan membayar uang paksa serta membayar perkara sedangkan mereka bukanlah pihak yang terlibat secara langsung dalam pembuatan akta yang menjadi objek gugatan, oleh karena akta jual beli yang dibuat oleh notaris yang telah meninggal dunia dinyatakan batal demi hukum akibat adanya pemalsuan surat kuasa jual. Penelitian yang digunakan adalah yuridis normatif untuk mengetahui lebih lanjut mengenai bentuk pertanggungjawaban dan perlindungan hukum bagi pemegang protokol notaris yang digugat oleh pihak ketiga terkait dengan salah satu protokol notaris yang disimpannya.

Applied research is normative juridical to learn more about the forms of accountability and legal protection for share holders who sued the notary protocol by third parties associated with one of the notary protocol that he or she keep.
